I have this condition. My current H1b is being renewed by my current employer (my H1B expired 15 days ago and the lawyer told me that I am good to work thru May 2013 after having received the receipt notice (I797C) . However, the decision on its approval is still pending in USCIS.

Now, I have found a new better job and I believe they will also need to file a new H1B for me. My dilemma is - Will I still be in status if l quit my current employer and work for the new company after receiving a new receipt notice (I797C) for this very new company? How does this work since the decision on my current H1b extension is still pending?

Looking forward to your suggestions!  Thanks a lot ! :)
