dkhanal, I'm absolutely dumbfounded by your audacity to make such a filthy and unnecessary comment. That was totally uncalled for.

ryan25, I'm not sure how this works but try to ensure your buddy has some thorough legal guidance before you guys take a step. USCIS might find it a bit fishy (they normally scrutinize these cases thoroughly) and cancel your buddy's DV, citing this as immigration fraud, leaving him ruing this decision for the rest of his life.

This is quite a dilemma regarding what should be the proper thing to do versus the right thing to do. There will always be the police of morality who will preach you not to do unethical or illegal things but these same people will not hesitate to cheat in exams, file for asylum, fake their resume, have someone else take their interview for them or sleep with their friends gf wife if they got a chance.

You can always test the waters by getting some opinions but you should feel free to do what would be the best thing to do. Having your gf 'marry' your friend to come to the US does not hurt anyone and that's the basis of ethics I try to value most of the time if it comes down to that. In this instance, noone is hurt so no need to feel bad about it if it works out.

US embassy checks for validity of marriage. So u need to provide photos for the weeding. How many people are present. Court marriage only I would say would be a NO NO. If you are really so desperate you really need to have an actual marriage for your gf with your friend. Video tape to provide authenticity. I don;t know it photoshop would do for you or no. They really ask you about photos and then who the people are in the photos. US embassy doesn;t really accepts only court marriage papers for authenticity of your gf/friend's marriage. They require further evidence like wedding photos, wedding videos, wedding invitation card, wedding party palace photos bill etc. If you can really produce all these things you can surely go for it but don;t assume only marriage paper would do any good for you.
Regards,

Ryan25,
This is doable. Many people have done it. Some did it because they indeed got married after the fact. Others did it, as it was one of the means to bring along a friend or a family. Other might have done for financial reasons.

Morality is thing you decide for yourself. I don't know you and I will never know unless you tell me. If they don't take 7-circles of jagge, then they are not married in your or my view. Its a 'fake' piece of paper between two people, with intention to circumvent the kanoon.

Is it legal. No. Is it moral, probably not. Not legal is almost always immoral too. sometimes legally done things are also immoral.
To your last question. I believe they have to stay 'married' for 2 years. I may be wrong. What issues that clause itself can bring into play? Lets see.
He will be responsible for your gf, legally and economically. He may be required to buy health insurance for her. He may be liable for her medical bills. Their credit may be tied together. You and your gf won't be able to get married 'legally'. She will have claim on his income and property, including Alimony. If you make her mother, in these two years, he may become the father and again buy medical coverage.

Your friend won't be able to get married until he divorce her. If he finds someone who says 'marry me', he will have to say no.

Can it be done? Yes
Will I do it? No
Should you do it? Your call

Hey Ryan25,

I think PerryBhadra has a point. One of my friends came to US. He went back on vacation and married his gf. Because they were afraid their parents won't approve of their relationship, they did "court marriage". They thought once both are in the US they will let their parents know. The guy came back and his wife applied for US visa and got rejected. They asked "jagge ko photo khai?" The embassy didn't believe the marriage certificate. Last time I was in Nepal her visa application was rejected several times. I don't know the current situation.

So bottom-line, I'm not trying to discourage you, but I have seen somebody's application being rejected just because they didn't have photos of wedding ceremony. If you are lucky, you can get away with it. However, if you get caught, your friend's DV will also be cancelled (as mentioned by riddle). So think wisely.

Best Approach:

Have them get married as usual in the same way like जन्ती, श्वयेम्बर , invitation, party and so on. Take as many pictures as possible including videos. Make it look real. And also make court documents if needed. There won't be any doubt in this way. This is (like) a real wedding. Just have clear understanding with your friend that they don't do anything you don't like such as "this and that".

Once they are here, have them get divorced. And you marry her. Done. It is fair, clear and legal.

Be very careful! Mero ekjana bhinaju lai DV pareko thiyo 5-6 barsha jati agadi. At the time of filing he claimed to be single but when he won the lottery he was legitimately married to my cousin. He was denied Visa because US Embassy was suspicious of his marriage.

According to Patanjali Yoga Sutra No. I.6, all apparent movements of mind can be categorized in five main categories:
1) Proven Theory
2) Wrong Knowledge
3) Imagination
4) Sleep
5) Memory

Ryan 25's mental modification comes under "wrong knowledge" and "Imagination." Wrong knowledge includes assumptions, presumptions, deductions, unsound thinking etc. Imagination includes all fancies, hallucinations and anything that forms a mental image that has no solid scientific ground.

What makes humans different from animals? It is Dharma (Right Conduct). Without right conduct humans are animals.

An Utopian society is impossible where there is mind because mind itself is the result of ignorance. However, we can mitigate evil tendencies from our societies by bringing higher qualities present in the human mind. I do not blame Ryan 25 for bringing such evil thoughts because society as a whole is responsible for nurturing such ignoble thoughts. When education becomes ill, where results and numbers are valued more than the means to achieve such results, we will create more Ryan 25.

Idea is NOT bad.

But in reality, this process can take years. Remember, we are human. We have emotions. Our behavior and emotions can change with Time and, with our Surroundings. Above all, woman is involved in this case.

1.After their arrival in US, You all three have to live under one roof. Three is a crowd.

2. Legally, your wife will be calling your friend, "shreeman" in front of you, God knows how long would that be. What would happen is she feels comfortable calling your friend "shreeman"?

3. Somehow she gets preg ( don't worry, it yours) but what would you do on Child's Birth Certificate, Father's name. You can't put yours. She is legally married to your friend.

And there are many more social factors directly involve with emotions. Lawyers are helpless in this kind of events.

@sexyinsari sometimes people get separated and have someone else's babies without getting legal divorce. I don't think thats an issue.

@ goddamn,

the question was answered based on the case scenario. NOT in a general sense.

DV winner man is sponsoring a woman base on marriage. Process will take 3-4 years.

As you said if they get separated, do you think green card process will continue?

Or at the time of interview, if a woman has a child from a another man, but she is still married

to her husband, do you think immigration officer will close his eyes and approves the case.

This is the case scenario.
OMG!!!! I don't even know why I am here. Bunch of kids!!!!

@sexy I think OP is here and the gf is in Nepal, so don't worry about baby. And about 3/4 yrs if you are not talking about general, for visa current date for spouse is not that long.
If the gf gets visa then she will have her own green card upon arrival, so only problem is how to null the previous marraige.
I am not encouragin OP or anything but the suggetions does not make any sense, so just playing the devil's advocate. And thanks for talking to this kid. Cheers :)
