Hello Everyone,

I am a regular sajha viewer but I hardly post anything.
I have a question which I think fellow sajha users might be able to help me with so I am looking for your inputs.

I am planning to go to Nepal for H1B stamping.
I work on a EVC (Employer-vendor-client) model.
My employer is a dhoti consultancy and I am currently on a 4th project (3rd company/client) working at client place. I have a prime vendor and another vendor in between my employer and the client.
I have been with this employer for over 3 years and I plan to get my H1B stamping in Nepal.
However, since I work at a federal regulated client, they do not provide client letter.

Is it safe for me to travel to Nepal and get H1B stamping without the client letter.
How important is it to have a client letter given that I have all the documents needed to prove my eligibility working on H1B for over 3 years with the same employer.
Is there any risk or chances that my H1B might be revoked or I might get 221(g) for further investigation.

I am looking for any suggestions/inputs from your side that might be useful for me so that I can travel to Nepal or any reason as to why I should not travel back home for H1B stamping.
Any other or additional documents that I might need to take so that I can get my stamping done without any issues.

You work under EVC model and I assume your employer runs your pay stub, so there would be actually no proof that you're working at the client location unless the client writes a letter for you. I think client letter is very important.
Also, I work for the government under EVC model and they've always provided me with letters whenever I requested. So, just talk to your manager. It should not be a big deal !
If it's impossible, the least you can do is print some non-confidential work emails that you send/receive from your client email. Take your work photo ID with you as well.

One of my coworker had the similar issue. His employer or vendor sent an email to HR and they provided confirmation in the email that this person is working in the client location. This is alternative to client letter.

Thanks datktmguy and GoneCrazy for your insights.

I talked to one of my co-worker and it seems he went for stamping (Indian) with the email from his manager where it stated that the company does not provide client letter but confirmed that he worked at the client location.
He had printed that email, but the consulate just took out the that piece of paper during the interview and waved it right in front of his eyes and told him that the email is fake.
All he could do was just stare at the consulate with nothing to say.
Thought I would share his experience, I don't know what I am going to do if the same happens to me.

I will take the email and some confidential emails including my work badge with me as datktmguy suggested and as suggested by GoneCrazy.

At this point I still think its very risky without the client letter.

I would appreciate if you keep them suggestions coming fellow sajha users.

I cant believe there were only 2 suggestion after 256 views.
Had I posted a picture of nepali girl and commented on her, I am sure this thread would be 2 pages long.

I am just looking for your honest opinions and suggestions everyone as I thought this would be the best place to seek help from Nepali friends.

These days any immigration related matter is like winning in a black jack. The odds are pretty even. But the odds starts depleting when other stuffs start coming into picture.
In your case, it is the client letter. Now, does client letter guarantees you the visa? Certainly not. But it makes a very strong case since you are in a EVC model (is it EVC or EVVC?). Will they reject your visa or put you in a long wait with administrative processing? May be. The odds are against you at this point. Also, sometimes that email things works. But in your case, I would assume they will be extra careful since it is a federally funded client. I would strongly suggest you to 1) Amend your H1B to match the LCA and H1B, if you have not done yet. 2) Get a client letter from the client. 3) Worst case look for a new client who provides client letter and go from there.
My case, Same employer, same client since 2010. I had the client letter with me. They still gave me 221 and did a inquiry to my client manager and my visa got approved in 3 days. I was in canada last year. Going back again next month to the same location (I dont like to take chance in Nepal, my own personal , superstitious reason) with H1B extension with everything else same. Oh yah, I have similar type of client too.
There is one thing to take extra risk and another to just to take the risk. Either way, it is your personal call and decision.

Hi Jammin,
I have the same issue, client does not provide the letter. When are you going for stamping? I am planning to take following documents. Please add if I miss anything.
1. Email response that the client does not provide the client letter.
2. ID Card (Badge).
3. Time Sheet.
4. Picture of you working at your cube, Client Building and phone displaying your name and number.
5. Email Communication between you and your manager for your holiday approval.
6. Your name in company directory listing.
7. Your name in organizational chart.

HI Namaste!

These are the following documents that i carried:
- Complete list of documents while filing your H1B (provided by my employer)
- all ur original academic certificates.
- I-20's
- pay stubs
- I had client letter in my case
I believe complete list of documents while filing your H1B includes necessary documents for interview for h1B stamping. I also carried list of documents mention by (ohio) just for back up. also please do make sure if others documents needed too or not?
