I'm on Asylum based EAD, I'm thinking of H1 though desi consultancy. If H1 sponsored, can I get the visa stamping from Mexico, as I've pending Asylum can't go to Nepal. How do i do the labor ministry thing in Nepal. Does this whole thing is even possible?? I came in J1 visa, I applied for Asylum after my J1 was expired but within 1 year. plz help!!!

Pending asylum applicant can apply for advance parole and travel.

Catch 22: u cant stamp ur H1 while traveling on AP.

You can take risk of course but ask any lawyer they wouldn't recommend it. There might be some case of returning but totally depends on your POI officer.

no even with advance parole, you will be self deporting yourself in removal proceeding hence getting yourself 10 years ban, get voluntary departure or administrative closure of the case before leaving county in AP if you are in removal proceedings...that is what i have found out from all the reading i have done..

U applied for asylum after ur J1 expired. So that is the problem. I wonder if u can adjust through H1. U r technically in out of status. If u had applied for asylum before ur J1 expired, u will be technically under status and could have adjusted through H1 by going to Mexico on AP and getting H1 stamped.

I got my AP through TPS while I was in removal proceedings. I have sent the motion to the court to administratively close my proceedings. DHS didn't oppose my motion based on grant of TPS and no criminal history. I am planning to travel on AP. My lawyer said, i will get a 10 year ban. I read about the Matter of Arabally, that i will not trigger 10 year ban upon leaving and returning on AP. How true is that?

Based on ur other posts, ur only options are win asylum case or marry a citizen. Present more+stronger documents to backup ur asylum case. It can be done. If u dont mind, How u got misdemeanor ? DUI ? U cant be that stupid when u have such a fragile situation. Otherwise u could atleast have TPS by now.
