Does One( F2, H4) violets he/her current status when just applying TPS EAD (SSN) but not uses it for work? Isn't that right violation of current status(F2,h4) only occur when he/she use TPS(EAD) to work? Please shed some lights on this. As all of you know that (F2,H4) or any dependent are not eligible for SNN, whole point here is trying to find out if dependent can acquire SNN without losing their current status. Your valuable info are highly appreciate. Thnks :-)

I don't think you violate the f-2 status even if you work using tps ead if you maintain your f-2.

Furke, I hope not as well, but isn't that right maintain f2 means obey by all its F2 does and don'ts. for e.g. F2 and H4 are not eligible for work and we are aware of that. and when F2 or H4 apply for TPS and TPS(EAD) use it for work, he/she is will no longer in their current status. only applying TPS won't hurt, but its something gets different when he/she apply for TPS(EAD) and use it for work. I might be not 100% right , thats why i am creating this thread so that we can have in depth knowledge. Thanks

Just applying and not using tps ead should not ve a problem at all. After all, you never worked in f-2 and thus maintained status.

It looks little controversial. Even the attorneys at 'avvo.com' share mixed reactions. Some states it doesn't violets some say it does. In my understanding if f1 changes status, then f2 will no longer be f2, in this case if f2 uses EAD , its trouble because u can not change your F2 non-immigrant status by staying here in US provided you fully utilize the benefit of TPS--meaning if you used EAD. However, you can change to immigrant status, for example green card. So, as long as F1 remains in F1, F2 should be fine, in terms of status. Lets put one hypothetical situation, if F1 changes to H1 and F2 in already fully utilizing the benefit of TPS---meaning using EAD, now, F2 can not change to H4 or other non-immigrant visa. F2 has to restamp the visa by trying to re-enter the country. Please comment if I am wrong.

just FYI... these days H4 can work, provided they meet certain requirements. You can apply for h4 EAD and then SSN. I can tell you one thing -- just getting SSN doesn't voilates any status. SSN has no link to yours status.
