Got selected for DV, applied for DS 260 with the option to change status while in the US, KCCDV sent an email to check with USCIS if are eligible for change of status and if yes, pay $330 for change of status to KCCDV. Question: Do you pay this $330 before the second letter (request for documents) comes in? or do you wait for it and once it gets processed, you send out that $330. KCCDV also says you will have to wait for your case to become current to file for change of status with USCIS. Please help, the guidance is really weird. Anyone that has had similar experience with changing status while in the US? Also if you don't pay this $330 do they fix you up for consular processing?

Check visa bulletin. If your case no is current then pay dv fee. After you get the receipt of payment. Prepare for I-485 AOS documents. Look at some DV blogs which may be helpful to you.

No need of DS260 if already in the US. Look for the Lottery Rank Number, if it is less than 8800, that person can file for Adjustment of Status (form i485) in the US. Filing fee is $1225.

No need of DS260? but thats the first thing they ask you to do? so I have to wait for the document submission email first? I think it comes in a month before your case number becomes current as per what I have seen with other winners

That’s one of the option not the only thing they tell you to do. DS260 is for visa interview at US Embassy Kathmandu. If the lottery winner is already in the US, why to go for visa interview, just file for AOS in the US.
But to correct one of my post, yes pay $330 to Department of State and after getting the confirmation, file for AOS in the US.

So people that are in Nepal have told me that they received request for documentation. My case number is very close to being current now but I have still not received a documentation request yet. ( Already submitted DS 260 and about to submit the $330 to KCCDV. )Am I doing anything wrong here?

You can send the AOS package now. Do not be late. With this Corona thing, you may not get scheduled if you wait too long. Remember you can't get visa stamped after Sept 30 2020. Pay the fee! Send the AOS package if you are current next month or so. Last edited: 16-Mar-20 09:41 PM

Did some research and found out that I do not get document request from NVC at all. Panicking a little here. would I have enough time to file for AOS? My number would be current in June but I can apply for I485 next month most probably. anyone went through AOS with DV recently? How long does it take?

AOS with timely sent application may guarantee that you get interview before the DV fiscal year, but if you have ever worked w/o authorization then should go for CP. Since you said TPS , safe bet is to get Advance Parole and appear for interview at KTM, But with this Corona thing , and the embassy has cancelled all the immigrant & non-immigrant interview, your safe bet is to do AOS here. CP has less paperwork and less strict in terms of granting visa (but cannot be appealed if denied) while AOS has more paperwork and can be appealed if denied. p.s not sure why you lol after each post. i know it is for your freind lol

You are not the first person to say that I use lol too often!!! God dayum! This is so much uncertainty. What I think I am gonna do right now is work both ways. If by the time my number becomes current and I can file for AOS, if the corona shit simmers down I will go home and do it, otherwise I will just switch over. Apparently KCCDV is very flexible for this. Just will waste a shitload of money and time. "lol"

Keep in mind that Advance Parole takes many months to get approved unless you already have it. I think you should go for AOS unless you were out of status or worked w/o authorization using SSN.

I have biometrics for AP in like 2 weeks. Thats what I am thinking too, I mean if the corona virus travel bans don't simmer down by a month, I have to do AOS, no choice. I did once work during summer break, but that was more than 5 years ago. I am preparing paperwork for both routes rn. I'll switch to AOS when time comes if needed. But if my interview gets scheduled in Nepal... I'm going for it.

You should be able to do it yourself. If you need help follow the link below and ask question. Go through the AOS process entirely before asking. having said that Trump will put pause for 60 days in greencard processing, not sure how this will play out when he comes out with plan tomorrow. Thanks people! Panic hired the lawyer and paid a little money because of all the uncertainty and my status being on TPS. I'll try to terminate the contract since he has not started anything yet and if the paperwork cannot go through at all then there is no point. Visa bulletin almost 2 weeks late this year, might be because the trump administration had this plan a while ago so number won't be current anytime soon.
