- Surya Nath was not appointed by king but by democratic government before Oct 2002
- The law used by CIAA to arrest all corrupt criminals were passed through parliament before its dissolution
- CIAA never bowed in front of palace, thats why palace formed special illegal commission to take its political revenge action.

If this government takes action against CIAA, it will be a sad action, and will only be strengthen our fear that leaders have not realized their mistake. CIAA report damns 27 big shots, many others

KATHMANDU, March 10 - The 13th annual report of the Commission for the Investigation of Abuse of Authority (CIAA) which was made public on Monday by command of His Majesty the King, in accordance with the Article 127 of the Constitution of the Kingdom of Nepal-1990, has pointed out that 27 persons holding public posts had earned illegal property and led an unnatural lifestyle, and therefore cases have been filed against them at the Appellate Court and the Special Court.

The report states that cases have been filed against other 64 persons in order to confiscate the property, as the 27 accused had deposited their property in the names of their wives, sons and daughters as well as relatives.

According to the report, three former ministers Chiranjivi Wagle, Khum Bahadur Khadka and Jayaprakash Prasad Gupta have been accused of corruption of the largest amount.

Former Minister Wagle was accused of illegally earning Rs 32,955,071, Khadka Rs. 23,687, 634, and Gupta Rs 20,808,046 and the CIAA has demanded maximum of punishment for them.

The CIAA has also demanded further punishment to them as they were in the ministerial posts.

Likewise, the then general manager of the National Construction Company (NCC) Ramagya Chaturbedi and chairman of the company Krishna Kumar Ghimire had earned illegal property of Rs 69,182, 535 and Rs 11,550,000 respectively and have been demanded further punishment against them by the CIAA.

Accordingly, it is stated in the report that the then Director General of the Department of Roads Ananda Prasad Khanal amassed Rs 39,740,073; joint-secretary at the Ministry of Finance Shreeram Panta Rs 11,767,326; joint-secretary at the No. 2 Internal Revenue Office Janardan Sharma Rs 16,333,548; under-secretary at the Department of Customs Sarad Kanta Adhikari Rs 9,841,820; under-secretary at the Internal Revenue Office area No. 1 Bharatraj Subedi Rs 4,345,643 and under-secretary at the Ministry of Finance Ishwar Prasad Pokharel Rs 12,303,695.

Likewise, the report states that Chief Customs Officer at the Mechi Customs Office Keshar Jung Khadka amassed Rs 14,562,174 through illegal means; director at the Department of Customs Khem Raj Bhattarai Rs 24,563,878; section officer at the Department of Customs Devi Prasad Bhandari Rs 6,778,426; section officer at the Department of Labour and Employment Promotion Ganesh Aryal Rs 4,240,702; section officer at the Ministry of Finance Suresh Kumar Regmi Rs 5,484,255 and the Chief Customs Officer at the Bhairahawa Customs Office Ganesh Prasad Shrestha Rs 18,605,015.

CIAA files chargesheet against Sharma

KATHMANDU, Nov 28 - The Commission for the Investigation of Abuse of Authority (CIAA) today filed a case against former finance minister Rabindra Nath Sharma in the Special Court, after 39 days of judicial detention. Sharma has been accused of amassing property disproportionate to his known sources of income and being involved in a gold-smuggling scandal about seven years ago.

According to a CIAA source, Sharma has earned Rs. 49.55 million from unknown sources and embezzled about Rs 11 million in the 100-kg gold smuggling scam. The gold was brought to Nepal from North Korea in a Singapore Airlines flight and was found in a disowned state at the airport.

Sharma is former vice president of the Rastriya Prajatantra Party and a confidante of Prime Minister Surya Bahadur Thapa.

In the charge-sheet, according to a CIAA source, Sharma has been alleged of using the money from the gold scam to buy votes of the parliamentarians to escape the no-confidence motion at that time. The source further said that Janardan Sharma, the former chief at the Tribhuvan International Airport (TIA) Customs Office, withdrew the amount to pay the informers a commission as per the practice. There is a practice of paying 10 per cent of value of the confiscated articles to the informants. But, instead of giving the money to the informers, he gave it to Sharma.

The CIAA has sought confiscation of the allegedly illegal property, fines matching the crime and imprisonment in the charge-sheet against the RPP leader. The CIAA had arrested Sharma 39 days ago to investigate into his property as the report of the Judicial Inquiry Commission on Property (JICP) indicated his names among 40 corrupt politicians and bureaucrats.

Sharma’s allegedly illegal property includes a house worth of Rs 7 million at Bishnu VDC, Kathmandu, property worth of Rs. 20 million in the name of his two sons, three private vehicles, including a Pajero. Besides, he has invested Rs 4.1 million in shares and lent millions of rupees as loan. He has claimed agriculture as the source of his income in the statement submitted to the JICP.

Meanwhile, the CIAA today decided to put on hold the corruption cases of former ministers Dhundi Raj Sastri and Devi Prasad Ojha. A CIAA statement said that the investigations into their property could not establish the allegations that their earnings were from unknown sources.

Golden truth

A source at the CIAA told The Kathmandu Post that North Korean diplomat Jo Kun Ha and others had smuggled the 100-kg gold into Nepal in a Singapore Airlines flight via Singapore. The gold was found in a disowned state.Meanwhile, the CIAA today arrested Janardan Sharma, former chief of the Tribhuvan International Airport Customs Office who was involved in the gold scam, from his residence at Bishalnagar. The source also added that Kripaswore Sherpa and Madhav Raj Pokharel, who were the staff working under Sharma during that time, were acquitted of their charges in the scam for cooperating with the CIAA investigation team.

Khadka, Wagle, Gupta at CIAA

Former home minister and general secretary of the Nepali Congress (Democratic) Khum Bahadur Khadka for the first time gave a deposition before the empowered Commission for the Investigation of Abuse of Authority (CIAA) Friday.

Khadka was home minister in the ousted government of Sher Bahadur Deuba. Commission sources said Khadka was questioned on contracts awarded to businesses when he was water resources minister in the undivided Nepali Congress government headed by Girija Prasad Koirala.

Communications Minister in the Deuba government Jayaprakash Gupta testified for the fourth consecutive day while number two man in the Deuba government Minister for Physical Planning Chiranjibi Wagle testified for the second time.

The Commission is investigating corruption charges and ill-gotten wealth of political leaders.

King Gyanendra Friday directed the Chand government to crack down on corruption and run a clean administration.

Nepal's international donors, including the United States and the United Kingdom, Friday welcomed a crackdown of official corruption.

Special Court Verdict
Reason To Be Hopeful

The corruption bug must now be finding a place to hide. So far, it had been biting people relentlessly encouraging them to make hay while the sun was shining. The historic verdict of the Special Court last Thursday that convicted former minister Chiranjibi Wagle of corruption must be giving sleepless nights to many other wily politicians. The verdict against Wagle has sparked hopes among the people that they would soon see a series of similar verdicts aimed at booking the corrupt.

Arrest
The Commission for the Investigation of Abuse of Authority (CIAA) had arrested Wagle few weeks after His Majesty the King dissolved the government on October 4, 2002 citing reasons of ineptness of then government to hold the elections.

The CIAA had raided the houses of former Nepali Congress ministers Wagle, Khum Bahadur Khadka and J.P Gupta after it was tipped off that the ministers had accumulated movable and immovable assets, the sources of which weren t clear. Prior to this, the CIAA had raided the houses of 22 officials working at the Revenue Investigation Department to evaluate their assets. Later the Ministers and other top government officials were released on bail while the Special Court continued to probe into the cases.

The raid had come a few days after the Commission was empowered though the passage of an anti-graft bill from the parliament that turned into law after receiving the Royal assent. The assets of those raided, which were disclosed to the public perplexed the common Nepalese who then inferred that the number of nouveau riche in the country had grown manifold within the span of the last two decades.

To the surprise of many innocent Nepalese, ministers with a below average financial condition turned into multi-multimillionaires. Tales of corruption made rounds in the social circles but failed to be proved. After the state of corruption started worsening, the Mallik Commission was formed.

Though it was formed primarily to investigate into the atrocities perpetrated during the popular movement, it was also mandated to look into the corruption allegedly carried out by the then rulers, popularly known as Panchas .

The report of the commission was never implemented for reasons unknown, which encouraged politicians to amass wealth by abusing their power. Corruption was carried out in an unabated manner; not different from the pre-democratic era turning poor politicians into the nouveau riche. Surprisingly the majority government headed by Girija Prasad Koirala after the first general elections in 1991did not make any move to empower the Commission for the Investigation of Abuse of Authority (CIAA).

The Communist party of Nepal (United Marxist-Leninist), which was in the opposition too did not show any eagerness to push the ruling Congress for a bill that would empower the CIAA. The repercussion was that politicians from different parties abused their power for personal gains.

After things started to go beyond control, a judicial commission was formed to look into the assets of government office bearers serving in all capacities after the restoration of multiparty democracy. The three member Commission formed two years back was headed by sitting justice of Supreme Court Bhairab Prasad Lamsal. The Lamsal Commission did a wonderful job, which could be ascribed as exemplary, as it prepared the groundwork to file cases against people whose assets were unrealistic compared to their earning sources.

The report after being presented to His Majesty the King was then forwarded to CIAA, which started the investigation to file lawsuits against the accused at the Special Court chaired by Tap Bahadur Magar with judges Govinda Prasad Parajuli and Bhoopa Dhoj Adhikari as the other members of the bench.

For those who were unaware about the legal provisions, the release of the indicted on bail came as a surprise. But the legal provisions were followed strictly until the investigations and hearings came to a decisive end.

KATHMANDU, Jan 21 - The Special Court on Friday slapped a two-year prison term, along with a fine of 19.79 million rupees on Ramagya Chaturbedi, ex-chairman of Royal Nepal Airlines Corporation and National Construction Company (NCC), for illegally amassing property while in those posts.

In its judgement, the anti-graft tribunal has also ordered confiscation of all his illegal property.

Besides, the court declared that Chaturbedi has stashed away about 11 million rupees, which was once deposited in two Indian banks – State Bank of India and United Bank of India – and was withdrawn later. The court has ordered deduction of the amount from his legal property and confiscation of the same.According to the court’s evaluation, Chaturbedi now owns property worth over Rs 25 million, legal property being only 6.7 million rupees. His illegally earned property stands at 19.79 million rupees.The court also said that illegall property in the form of land, shares in a hospital and medical college, and bank deposits are owned by Chaturbedi himself, his wife Asha, son Ritesh and daughter Aditi.

The court handed down the judgement in response to a case filed by the Commission for the Investigation of Abuse of Authority (CIAA) on February 13, 2003. The constitutional anti-graft watchdog had accused Chaturbedi of illegally amassing Rs 70 million rupees while serving in the posts in RNAC and NCC. He was a political appointee. The CIAA had sought five years imprisonment for Chaturbedi in the charge sheet filed at the court.

Wagle has challenged the verdict but it is unlikely that the proof against him to be submitted to the Supreme Court will allow him to come out clean. The historical verdict looks like only the beginning of the crusade against corruption.

Going by experiences from the neighbouring countries, corruption cannot be stemmed unless those who are in the top posts are booked for their misdoing. The verdict also has send fillers to other politicians in power that they will not be spared if they abuse their power in office to pocket resources that are supposed to go into the country s development. The CIAA following its empowerment through the passage of a bill from the parliament after nearly ten years of democratic exercise must be appreciated for all that it has done to bring the culprits to book. The government must work towards introducing laws that would empower other key bodies like the Election Commission to control the resource spending during elections.

Though the ceiling has been fixed in the regulations, the hands of the Commission are tied, as it is still not in the condition to initiate steps and take action against contestants, who violate the set ceiling as regards election expenses.

The basis of being elected to high office in Nepal is money and muscle rather than popularity and past track records. When politicians who spend whooping millions into election campaigns are elected they are tempted to make up for the loss through unscrupulous practices.

The government recently has done a commendable job by putting a complaint box at Singh Durbar, where people can file complaints if they are exploited by civil servants. This step too would augur well to some extent to curtail corruption in different government offices. Commitment
A corruption free society is always the rallying point for a functioning democracy. Hence efforts must be geared from all quarters public and private to stop the corrupt from going scot-free. Given the political commitment, the people can rest assured that the days ahead will be free from corrupt practices. The recent political development in the country that has culminated into the formation of an all-party government headed by Prime Minister Sher Bahadur Deuba is the opportune moment to work in the direction of stemming corruption from the root.

Ex-IGP Bohora in judicial custody over graft charges

KATHMANDU, Sept. 29: Former Inspector General of Police Motilal Bohara was ordered by the Special Court to be kept on judicial custody as the hearing of explanation from the former Inspector General of Police on charge of corruption did not end Wednesday. Bohara is one of the three former IGPs, charged by the Commission for the Investigation of Abuse of Authority (CIAA) for corruption. The CIAA had filed cases them at the Special Court more than a month ago.

Bohara has been kept under judicial custody at the ward police office Singha Durbar until the finalisation of the case. Bohara had presented himself before the Special Court on Tuesday.

Former IGP Achyut Krishna Kharel had presented to the court last week, but another IGP Pradeep Shumsher Rana has still not contacted the court.

I was chatting with my friends, one o them was telling me that NAGARIK SAMAJ is aware of some people trying to deface suryanath and he was saying that NAGARIK SAMAJ people will address this issue in a day or so. Removal of suryanath needs two third majority in house, so i dont expect UML to support it, its a dead issue for now.

I have heard of one minister's son in Aus/US and own a petrol pump bought from his dad's ill rotten money. (the minister has been investigated but not convicted yet, so will wait till he gets covicted to publicize the name)

Also there are lots of "fuche parash" haru son of "rotten corruption king" haru, who live in aboard at expense of their parents ill earned wealth and look down at the poor nepalese who are struggling to survive on their own calling them as "pakhe, gaunle and ..."

Hundi or Hawala was one biggest channel from transferring corruption money from Nepal to US or aboard.

US government came down tight on these channels after 9/11 as they figured out the money used to fund 9/11 emerged from these channels.

That was also the reason why international community started presuring Nepalese and other south asian countries to take strict action against corruption.

Bowing down to this pressure, parliament passed the strict law during Deuba Government before OCT 2002. CIAA used the law to clamp down corruption. Everyone welcomed their move at that time.

As a responsible citizen we should take step to protect CIAA and Corruption law from being victim of political revenge and opening the path to corruption again.

Govinda Raj Joshi's all kids are in abroad. 2 in US and one in AU. I also heard that they own gas stations in US and AU.

The youngest son had travel restriction from CIAA but fled to AU via India.

During the interrogation by CIAA about 30 million rupees [illegal wealth], Joshi said he got more than more than from his sons [17 millions]. Interestingly, that time, his both sons [in US and AU] were in school.

In support of his oust
During his tenure, he has involved in few corruption scandals.
When his one of scandal, fraud citizenship recommendation was revealed, and police tried to reveal it. He stepped it down and negotiated with Police IG by closing the case of his PA(who's still not being arrested) and IG has not spoked a word yet. Kantipur has also stopped following the case.

So, it shows that he's not the corruption free.

Furthermore, netas are asking for his resignation, not the change of rules, regulations or laws of CIAA. One of the reasons, he could take action against corrupted ministers was CIAA was empowered during his tenure. Irony is that the bill was presented in the parliament by khume (I heard).

It seems as Prajatantra pointed out, netas are trying to save their ass by doing this, as they did not give sufficient justification for removing him, unlike other constitutional bodies as Chief Justice, Chiefl Election Commissioner, Mr. Pawan Ojha (Hanuman of gyane).
He was not really a royalist, as king has to establish anti-corruption committee unconstitutionally despite having indepedent authority of CIAA.

If his illegal citizenship case was true, bring that out try him on that case.

Govt Sacks 16 GMs, Directors

The government today sacked 16 general managers (GMs) and directors of state-owned corporations and development committees with an immediate effect.
According to Punya Prasad Neupane, spokesperson at the Ministry of Industry, Commerce and Supplies, they were sacked as per the cabinet decision on Sunday.
GMs of Janakpur Cigarette Factory, Hetauda Cement Factory, Royal Drugs Limited, Industrial District Management Limited, Nepal Food Corporation, National Trading Limited, Nepal Transit and Godown Development Company Limited were given dismissal letters this afternoon.
Similarly, dismissal letters were also sent to executive directors of Cottage and Small Industry Development Committee, Carpet and Wool Development Board, Institute for Industrial Enterprise Development, and Inter-modal Transport Development Committee.
