Does anybody know the kind of visa I need to apply for bringing a chef from Nepal as I have a restaurant in US. Also, what are the procedures? Has anybody brought over a chef like this? Appreciate the input. Thanks

Lily Ji,
How long has your restaurant been registered here? Do you have tax returns for 2-3 years? Do you own a restaurant in nepal with the same name? if not the same name, did you own a restaurant in Nepal for some years and which is still running? is the chef who needs to be brought here, still working there in your nepali restaurant? Has been working there for at least one year in the last 3 years in the nepali restaurant, you own? Can you show corporate relationship between the two restaurants? Does the chef has specialised knowledge, extensive training, certificates, appreciations, special methodologies which are originally his/hers ideas?

If you can provide these facts, may be we can work on a visa catagory known as L-1B Specialized Knowledge professional. But the requirements are very very strict and the above mentioned crieteria must be fulfilled.

In L-1B visa, you can pay the person in the nepali payroll or whatever you desire here. There is nominimum wage restriction for L-1 B Visa. L-1B visa is for 5 years.

If there are partners, investors or owners of the nepali restaurant, they can come here on L-1A visa for 7 years. L-1A is for Executive and managers.

Both visa catagories pave a way to Green card and then citizenship.

Santosh dai, can F1 students file for asylum? I have seen some cases which are approved but most people say it's not possible. what is your say on that? How long it generally takes for a H1 visa holder to get a green card, if the sponsor is willing to sponsor. What in your opinion is the best, quickest way towards green card?
Please share your thoughts. Amazing website and great work of advising here in sajha dai.. Dai like you are very needed to show us some light in the valley of death for most students and h1bs...

1. Can F1 students file for asylum? I have seen some cases which are approved but most people say it's not possible. what is your say on that?
-yes, F-1 students who are in status may apply for asylum. App,lying for asylum does not affect your F-1 status at all as long as it has not expired. Filing for asylum while being on F-1 is a plus factor because even if you do not get asylum by any chance, you do not have fear of being deported because of the status you are holding. Grant of asylum is completely based on the circumstances you haev faced and fear.

2. How long it generally takes for a H1 visa holder to get a green card, if the sponsor is willing to sponsor?
-Once you are on a H-1B, the employer can file for Labor certification and PERM. After filing for PERM i.e. ensuring that there are no similar US citizens or permanent resident candiates in the US; the company can file for I-140 and you can file a I-485 concurrently for adjustment of your status from Nonimmigrant to Immigrant. The whole process may take from 6 months to 1 year after H-1B.

3. What in your opinion is the best, quickest way towards green card?
-For Nepalese, the best way is the DV lottery, do not forget to file for DV lottery every year regardless of whrere you are.
-Secong Option is to file for asylum if you have a sound case.
-Third option is for employment based green card explained above.
-forth option is family based petition which takes longer period and depends on the DOS Visa Bulletin processing dates.
-fifth option is investment based green card of $500,000 which immediately creates green card.
sixth option is O-1 (extra ordinary ability) or P-1 (permormers, artists, actors, atheletes) catagory where you have to be able to demonstrate that you possess extra ordinary ability in sciences, arts etc, have national and international acclaim, have received national and international awards of significance, have been nominated in major titles, have registered patent for discovery or invention, have adequate publications in the filed of expertise,and can demonstrate from related organisations (peer groups) that you possess that height.
