Hi guys, My friend had been living in a private property for one year. He had paid the security deposit of $ 11,00. When he left the place the owner did not complain about anything and said he would mail him the security deposit back. It has been more than one month and the owner has always been avoiding the calls of my friend. Finally my friend got him on phone today but the owner now says he cannot pay him back because the apartment smells like curry and because of that he had to spend a lot of money. He says the curry smell is everywhere in the walls, AC fans, carpet and does not go how many times he cleaned and painted. Have you ever heard of that?????????? We had helped him move and the apartment was very clean not even a scratch in the walls and a spot in the carpet. It is very rediculus he comes up with such an excuse not to return that money. Carpet pherne ra wall paint garne ta ushko jimmewari haina ra? Dont they do it everytime when people move out?? He is a student and that is a big sum of money. Can you all suggest what he should do to get the money back.. thanks

Gamle bro, Tell the landlord that you are going to file a police report. If that doesn't budge him, try filing one for real. Trust me if he knows that he is wrong by not giving the money back, he'll give it back as soon as you talk about a police report. Some khaires are just plain old laatko bhoot. Good luck.

If you're in the 5 boroughs of NYC, then you need not worry. Here all the laws are geared towards the support of tenants (as majority of the NYkers rent unlike other cities/towns and lawmakers gotta keep them happy). Just let the owner know that you'd inform the NYC housing dept about him not returning your deposit...I did the same to my previous land lord a few years ago as I only gave him a 15 day notice (and he had always told me to let him know a month earlier...but sometimes plans change and there is nothing we can do about it). As always, I got all the money back with threats of complaining to the NYC Housing department and a few threats of calling the police too. Now, I feel you should Let your landlord know that according to the law, he should return the deposit back with interest. Also to add fuel to fire, tell him you would've let go the interest but since he's acted like a dick, you will now take every penny of it....Then smile as you see his face frown with fear and anger.
