I filed my 485 on 17th of august and still waiting for receipt notice. it should come within next couple of weeks and may be after 15 days of that i should receive finger printing notice. I am planning to go to Nepal for next two months. So my question is what will happen to my fingerprinting in that case. Can I reschedule it for later dates and is there any disadvantages on doing that. any immigration expert out there ...........

Oh you are planning to go to Nepal so soon... would you not need to wait for your Travel Documents? From what I hear, if you go abroad without your Travel Docs or Advance Parole, then you might be seen as have abandoned your GC application. Furthermore, due to the mad rush to meet the August 17th deadline, the lawyers are not sure when the EAD and Travel Documents will be issued. Usually you get those documents within 90 days of receipt date. Not exactly the answer to your question, sorry, but I am curious to know what you and others think/know about the above subject.

i have valid h1b and valid stamping. so it shudnt be a problem. I already checked ins web site and even talked with my lawyers. its no big deal. if you don't have valid visa and valid h1 then in that case u need travel document. but my case is different. So I can travel. anybody out there who has more knowledge about fingerprinting...........

You may not have problems returning to the US without AP if you have a H1B visa, but USCIS will abandon your I-485 case if you don't show up for the scheduled biometrics appointment. You'll have to start over in that case.

Xbox, I don't think you will have any problem as long as you can reschedule the appointment for fingerprinting. However, I read in one of the immigration forums that a person who went to India after sending the FP notice back to USCIS with request to have the FP appointment rescheduled was denied on I485 as the USCIS deemed that the applicant had abondoned the application. But, there is a certain time frame where you can appeal that decision and have your case reinstated. If your attorney is telling you that there would be no problem, then go to Nepal and enjoy the trip.

You can request reschedule of the appointment after you recieve the notice, if you don't show up at the appointment date and time, then USCIS will consider it as abandoned. I guess it is better for you to wait for the notice letter and leave for Nepal.

Yes you can request for the rescheduling.You can find it in the bottom of the notice paper with instruction.

MAKE SURE THAT U RECEIEVED YOUR RECEPT LETTER CONFIRMIING DATE OF FINGERPRINTS OTHER WISE MIGHT GET DELAYED SO AFTER THE CONFIRMATION OF YOUR FINGER PRINT DATE YOU CAN LEAVE BUT MAKE SURE YOU ARE ON TIME FOR FINGER PRINTS BECAUSE ONCE IT DELATED YOUR WHOLE PROCESS WOULD START AGAIN AND MIGHT HAVE TO WAIT AT LEAST 2 MONTHS OR MORE

jhaterakancha, lets say i got my receipt and fingerprinting notice next week and lets say finger printing notice is for next month but since i am planning to go to Nepal next month, I can reschedule it right. while rescheduling it, can i give them my available date or they will give me new date again.

xbox, I thought they wouldn't ask you for FP right away. But, if they do, it's not good idea to reschedule. I think it will delay your process. I have one additional question to those who are experienced ppl. Do they ask for Finger Printing before they issue travel document or TD doesnt need finger printing?? I filed my case in July 18, received receipt two days ago. I just checked status online: my and my spouse EADs are ordered. But I am waiting for TRAVEL DOCUMENT, which is the most important thing for me right now.
