simple man,
call any lawyer firm and tell your situation for sueing them. if ur case is strong , they will call u and if ur case is not so strong then they will say that they wont take ur case.and if u want to sue them with ur own risk then ........

i dont want to discourage u... but however if u lose the lawsuit u might even have to pay their court costs...and if they say it is frivolous lawsuit u might even have to pay their lawyer fees. be sure u have a real case... what u mean by mobile company ?? u mean like sprint, verizon, tmobile, helio ???

The case i like this, "Its been 2 months i added a phone on my family plan...the phone doesnot work at all, only receives sms, and its seems that iam a mere plandrome when i deal with the district mobile incharge also..the customer service is helpless and hects is moreover.......

go to small claims court as a lawyer in your case would be able to do little. Why I say its not worth it is because, You're contesting a phone line that costs $10-20 a month and you've been paying the charges for only the past 2 months now. Look at it, the monetary damage is insignificant here and unless you called them every day like a maniac for the last 60 days, not much mental/emotional distress charges could apply...Also, can you prove that this extra $20-40 has turned your life upside down (family problems, divorce, etc.)? If so, you have a case. BTW, even with a case, the only one who seems a clear winner ain't you or the moblie company, Its your lawyers!!
My suggestion: Keep harassing the phone company for a refund saying you'd complain to the BBB, Dept of Consumer Affairs and all the other such depts out there and if they still don't adhere to that, then finally think of going the full monty.

i can see why u are frustrated. the best way to go about this is by talking to a law firm.. as u mention one firm is interested in your case.. they will probably ask for your Contract. most major cariers have a part where they say u cannot sue them in court.. u have to go to a arbritator or something like that... but again depends on company and different contracts... but i dont understand why your mobile company doesnt just give u a new phone and try to fix the problem. i think most companies in US will just give u a new phone and tell u to return yours.. they will even send u the shipping box so you dont even have any cost. also they should even give u those 2 months earlier free since phone didnt work properly. call customer service and ask for supervisor and be NICE and explain your situation. u might be surprised. good luck though...

latoboy is absolutely right. Do not go behind money. u might be like one guy who sued a korean couple claiming 55 million $$$ for his lost pair of pant. So, whateva latoboy says u got to do that wisely. Hey keep in mind if you loose the lawsuit, then what ???????????????
Talk to the customer service, tell them your problem. They will solve it. Then chapter is closed.
