My elder brother wants to come to US to earn money. He wants me to sponsor him for a visitor visa. If I do that and he stays here after his I-94 duration expires, what is the risk for me? Is there a chance that my greencard may get revoked for "aiding and abetting illegal immigrant" or some other clause? What is the safest thing i can do? I want to help him without putting myself in the cross hairs.

Any logical and/or serious suggestion highly appreciated.

I would not take that risk till you get your citizenship. It might not be any deal at all, but there's always the risk being in the record later on in your life. But then you have the obligation for your brother. Anyway how involved is the sponsership for the visitor visa? I bet it's not that easy either if you're not a citizen.

For the visitor visa the sponsor has to say that s/he is willing to bear all the cost for the duration of stay of the potential visitor. I have sponsored student visa for my uncle's son but he is a very dilligent guy who is working on his bachelors with no intention of doing anything wrong. In case of my elder brother, he has family back home so just wants to work here for several years save as much as he can and go back. That's all fine, I have no problem with that. Actually I will be very happy if he can do that. But I should not put myself in trouble as well.

Krishna, I don't think there is any risk on sponsoring your brother even though he overstays also. Because it is he not you who will commit to return back to Nepal in the American Embassy. Embassy will rather test his attitude and urs income only and I don't think you will have any trouble later. The easy way would be, just transfer his visa to F1 as soon as he arrives, sab khel khattam tyas pachi ta. You will get easy admissions in cheap community colleges and they will easily transfer the visa.

Thank you solitude and hami1hau. Transferring to F1 sounds like a great idea. The only problem is that my brother is in his late forties, so I don't know how feasible it will be for him to be a student. But if doing that will get me "off the hook" I am willing to do it. That way it will be win win for both of us.
