 H1-B - Problem

I have some questions regarding H1B. Last time I applied for the H1-B but unfortunately I missed the quota limit. Thanks to Indian outsourcing firm. But anyway after that I joined the college for Master program. Now my employer is again filing for H1B on April. Firstly, my question is if I get H1B on April. Do I have to go back to college for Fall semester on August. Since H1B is valid only after October.
Secondly, if I get H1B can I apply for CPT to work until October.

Please give me suggestions and advice.

Answer 1:

You can stop classes the day your application for H1B gets approved. You dont have to wait till Oct. If you dont get that by Aug, then yes y'd have to go back for fall.

2) Depends on the scool. Some give you OPT starting sem, others dont. check with school.

Best- Join school and ask dhoti for cash payment. Thats what I am doing.

Thank you very much for the suggestion but my problem is I am not working with Dhoti, they won't pay me cash until October. Now, the question is can I apply for CPT until October to work. Will it affect my H1b in anyway.

Yes, you must maintain your status until October 1st.

Thanks for the reply. But Fall semester starts from August 19 and as far as I know you get 60 days grace period. Now I don't know where this grace period can be used. What I really want to do is to work until October first. Can I apply for CPT after I get my H1B to work just until October. OR will it affect my H1B.

--> 60 days grace period comes in picture only when you graduate (and applies only once for undergrad/grad/phd, you can't have two OPT for same degree ie 2 undergrad/grad etc).

--> For CPT and all, if your Professor and International Advisor don't have any problem then you are good to go, no need to worry about anything.

Thanks for the reply. I started my work under OPT, which I got after bachelor degree. Now, I am going for master not bachelor. So, my question is can I apply for CPT under master degree program until October when I get my H1B.
