if you don't have a job it is not a good idea to file for H1 right now, especially with dhoti consultancies. After the arrest of those 11 people a few weeks ago, it would be wise to be extra careful. Some of those 11 arrested were employees, and they are arrested for "submitting false documents". The H1 B visa process will be lot more stricter this year..so if you don't have a job its better to extend OPT. Also if you plan to join college later on, then it will be hard to change from h1 to F1.

Even Dhotis are asking 3000 dollar to file H1B.
ALSO: what is the process to extend the OPT??
Do we need to be employed to get the extension???

hi, @IRF540- Your employer can file your h1b but w/o COS(Change of Status) since u r under STEM category. The catch is if you will have your h1b approved you still have the chance to either get into H1b(with change of status from f1OPT to h1b) or work in f1(OPT) since you can extend your OPT. In the present economic scenario, it might take time to get a job and once you get a job, your employer can turn you into H1b with a change in status (i.e., u are now no longer in f1 or OPT) otherwise you will have your OPT period to fully utilize in looking for a job.But make sure your employer is e-verified so that u can extend your OPT. Do not file your H1B if you do not have job. Nepal_sach22, have you seen anybody extending their OPT after H1B approval without change of Status? Or You are just bluffing. If you have seen somebody doing so let me know the detail as well. If you have your H1B approved without change of Status, and you do not have job then you are double screwed. You cannot have your change of Status to H1B neither back to F1, if you do not have paystub. I have my H1B approved but without change of Status and without I 94. I contacted my University for my OPT extension and they told me that your H1B is already approved so your F1 is already terminated. So I cannot have my OPT extended. Since I did not have any projects so these MOFO consultancies also have not run any paystubs. Now I cannot go back to F1 and cannot go for Change of Status to H1 either. So, DO NOT FILE H1B WITHOUT JOB.

Hi, Mayakobarima- I was told differently that when u file h1b w/o COS, you can still use OPT period(12 or 17 months).I also looked at threads in murthy.com and found out the same information however I haven't seen anyone claim his OPT extension with h1b approved(but w/o COS). I felt sorry after hearing your case.I am still doubtful on filing h1b w/o COS thing. I agree that w/o a job, its even unlikely to get h1b approved in the first case. What did u do after your school said that your OPT couldn't be extended since u already got your h1b approved? How are u maintaining status? just curious to know the consequences. Thanks!

Thank you everyone for your views, I appreciate your help. I was thinking filing H1B from dhoti consultancy and transfer it to my major related job if I can find one. Do anybody know if it is possible to transfer H1B from IT job to any other engineering (an entry to mid level) position. or otherwise extend OPT for 17 months ??

Even (most of) the consultancies are not going to file H1b for people having no job. So everyone out there think twice before filing h1b without a job as USCIS will closely scrutinize the h1 applications and they will ask for PO too.(that means you have to have a real job,not just staying in bench and waiting to find one) i am just sharing what i have been told.Otherwise,i was also thinking to apply for h1b.

1. Do you need to have payroll keep running in extended OPT???? Or you can simply work as a volunteer or part time (20 hrs) as regular OPT?
