Katawal 'turns down' sack order

Chief of Army Staff Rookmangud Katawal, who has been sacked by the
government, has reportedly refused to accept the cabinet letter on his
sacking.


Government's chief secretary Bhoj Raj Ghimire handed over the sack letter
to Katawal soon after the cabinet decision, but he refused to accept it,
describing the decision as unconstitutional, it has been learnt. He said
he would consult his lawyers on the government decision.

Both Katawal and Lt. General Kul Bahadur Khadka were at the Prime
Minister's official residence in Baluwatar when the cabinet meeting took
the decision.


Prime Minister Pushpa Kamal Dahal had held separate and joint meetings
with both the Generals prior to the cabinet meeting, which was boycotted
by the allies.


Meanwhile, a meeting of NA generals called by Katawal is underway at the
headquarters, discussing the cabinet decision and its repercussions. nepalnews.com mk May 03 09

Source all Nepalese television channels including Nepal Television...The president, as he is the supreme commander of the army as well the chief of the state, has reinststed Rukmangad Katuwal and has dismissed the government's decision...He has sent letter to the Army secretariat, telling Katuwal to continue his duties and has also sent a copy of the decision to the Prime Minister...However, Prachanda is not ready to accept the letter :-) :-)

The government has sacked Rookmangad Katawal from the post of Chief of
Army Staff and appointed second-in-command Kul Bahadur Khadka as the
acting CoAS.


An emergency cabinet meeting Sunday morning took the decision. Minister
for Information and Communication and government spokesperson Krishna
Bahadur Mahara informed journalists about the decision after the meeting.


Prime Minister Pushpa Kamal Dahal is now going to meet President Dr Ram
Baran Yadav with the cabinet decision. The decision will come into effect
only after the approval of the President.













The cabinet meeting chaired by Prime Minister Pushpa Kamal Dahal in Baluwatar, which decided to sack Chief of Army Staff Rookmangud Katawal, on Sunday (May 03 09). Ministers from CPN (UML), CPN (Samyukta) and Sadbhawana Party boycotted
the cabinet meeting after Prime Minister Dahal tabled a proposal to sack
Katawal and replace him by Kul Bahadur Khadka, according our correspondent
Ram Humagain.


Madhesi Janadhikar Forum, which had been divided over the army chief
issue, wrote note of dissent, , opposing the procedure with which the
cabinet took the decision.


Emerging out of the meeting hall, local development minister Ram Chandra
Jha told journalists that UML ministers boycotted the meeting as the PM
brought a proposal to sack the army chief without a consensus.


Earlier, a meeting of the five-ruling parties took place in Baluwatar
Sunday morning in what is taken as a last attempt to find consensus
between the ruling parties to sack Katawal.


The Unified CPN (Maoist) is firm on its stance on sacking the army chief,
while the other parties in the coalition government are against the idea
of sacking him without a consensus.


Prime Minister Dahal also met CoAS Katawal and Lt. General Khadka
separately first before meeting them jointly.


The second largest coalition partner CPN (UML) and the main opposition
Nepali Congress have initiated exercise to make a new coalition, sources
said.


A standing committee meeting of the CPN (UML) has begun at the party
headquarters, Balkhu to discuss the party's strategy regarding the latest

It looks like things are pretty fluid in Nepalese politics. Maoist are saying that president's move is a constitutional coup.


I really want to see Maoist biting the dust in this case. So I would love to see (although I don't think this will happen) that Kul Bahadur Khadka speaks and says that he considers Katwal as a CoAS. This will also show unity within army.

This news is 100% true. I just watched Nepal1 channel. It's the breaking news that the President as a Raastradhyakshya and Paramaadhipati ko haisiyat le asked General Katawal to continue his office...

KATHMANDU, May 3: President Dr Ram Baran Yadav in his capacity as the Supreme Commander of the Nepali Army late on Sunday evening sent an official letter to Army Chief Rookmangud Katawal to continue in his post, defying his dismissal orders by Prime Minister Puspa Kamal Dahal.

In his letter, the President said, "Since the dismissal of the Army Chief and the new appointment do not meet the constitutional criteria and due process, I hereby direct you to continue as the chief of the Nepali Army."

The president sent the letter to Katawal late in the evening in response to a written request by 18 political parties in the parliament, including major partners in the current coalition government and the main opposition Nepali Congress, to protect the constitution and block action against the Army Chief. " The president intervened since the parties commanding majority in the parliament requested for his intervention to defend the constitution," said a source at the President´s Office.

The parties had asked for the president´s intervention ´to restore the constitutional supremacy´ and to nullify the government´s dismissal of the top army general.

A meeting of the parties held at the central office of the ruling Communist Party of Nepal (Unified Marxist-Leninist) at Balkhu on Sunday evening urged the president to exercise constitutional authority against the implementation of the Maoists´ unilateral decision.

The parties, following the meeting, went to the president´s residence at Shital Niwas to seek the president´s intervention.

Reacting to the president´s unprecedented move Finance Minister and senior Maoist leader Dr Babu Ram Bhattarai said, "This is a constitutional coup against an elected government." He also alleged that there was an attempt to establish the president as a parallel power centre and that the peace process had effectively come to an end.

Bhattarai also said the Maoists would not quit the government as it was elected by the people. "Instead we will protest the move from the government, parliament and street," he said.

Earleir, a joint press statement issued by the 18 parties said, "The Maoists violated the norms of the interim constitution and the spirit of the peace process, including the Comprehensive Peace Accord by taking unilateral decision."

It also said the Maoists violated the constitutional provision of consensual politics by ignoring the suggestion of the ruling and opposition parties. "We strongly oppose the Maoists´ decision and conclude to draw the president´s attention to the issue," said the press statement, signed by UML, Madhesi Peoples´ Rights Forum and CPN (United) and other parties including the main opposition Nepali Congress.

Emerging out of the meeting with the president, General Secretary of Nepali Congress Bimalendra Nidhi said Prime Minister Pushpa Kamal Dahal should immediately resign as the coalition partners had withdrawn their support to the government.

"The Maoists should allow the process of the formation of a new government. The Prime Minister should understand that he has lost the mandate to head the government and he should facilitate the formation of a new government," Nidhi said.

UML standing committee member Bidhya Bhandari, however, said "We are still in favor of consensual politics. The Maoists must revoke their decision of sacking the Army Chief to start a process of consensual politics."

Bhandari said a broader political consultation is further required to find a way out of the current political crisis. UML ministers have already resigned from the government.

काठमाडौं, वैशाख २० (नागरिक)- राष्ट्रपति रामवरण यादवले सरकारले अवकाश दिने निर्णय गरेका प्रधानसेनापति रूक्माङगत कटवाललाई पदमा वहाल रही कामलाई निरन्तरता दिन निर्देशन दिएका छन् नेपाली सेनाका परमाधिपति समेत रहेका यादवले प्रधानसेनापति कटवाललाई आइतवार राति पत्र लेखी यो निर्देशन दिएका हुन्

१८ राजनीतिक दलले सरकारी निर्णयप्रति आपत्ति प्रकट गर्दै राष्ट्रपतिलाई जानकारी गराएपछि उनले प्रधानसेनापति कटवाललाई पत्र लेखेका हुन् एमाले कार्यलय बल्खुमा दलहरूले बैठक गरी माओवादी निर्णयप्रति गम्भीर असहमति रहेको उल्लेख गर्दै राष्ट्रपतिलाई ध्यानाकर्षासहित जानकारी गराउने निर्णय गरेको थियो।

सर्वदलीय बैठकपछि दलहरूले नेपाली सेनाको परमाधिपतिको हैसियतले ध्यानाकर्षण गराई दिन आग्रह भए बमोजिम पत्र लेखेको उल्लेख गरेका छन् पत्रमा उनले अहिलेलाई काम गर्नू भन्ने आसय उल्लेख गरेका छन्।

 

संवैधानिक 'कू', शान्ति प्रक्रिया भंगः माओवादी नेता

राष्ट्रपतिद्वारा प्रधान सेनापति कटवाललाई बहालै रहन पत्र पठाएकोलाई माओवादी नेताहरूले 'संवैधानिक 'कू' भन्ने प्रतिक्रिया दिएका छन् माओवादी नेता तथा मन्त्री बाबुराम भट्टराईले राति अबेर नागरिकसँग भने- 'निर्वाचित सरकारविरूद्व यो संवैधानिक कू हो, अब शान्ति प्रक्रिया भंग भयो '

राष्ट्रपतिले समानान्तर शक्ति केन्द्रका रूपमा स्थापित हुन चाहेकोविरूद्व आफूहरूले जनतालाई अपील गर्ने जानकारी दिँदै भट्टराईले भने- 'हामी यसविरूद्व सरकार, सदन सडक, तीनवटै मोर्चाबाट सशक्त प्रतिरोध गर्छौँ।' आफूहरू निर्वाचित सरकार भएकाले सत्ता छाड्ने प्रश्नै नआउने जिकीर पनि भट्टर्राईले गरे 'कसैले अविश्वासको प्रस्ताव ल्याए त्यसको सदनमा सामना गर्नेछौं '


एमाले सरकारबाट फिर्ता
प्रधान सेनापति हटाएको विरोधमा प्रमुख सत्ता साझेदार नेकपा एमालेले सरकारबाट फिर्ता हुने सरकारलाई दिएको समर्थन फिर्ता गर्ने निर्णय गरेको छ। महासचिव ईश्वर पोखरेलले नागरिकन्यूजलाई यो जानकारी दिएका हुन्।

भावी योजना तय गर्न एमाले मुख्यालय बल्खुमा बसेको १७ दलको बैठकले नयाँ सहमतिको सरकार बनाउन मार्गप्रशस्त गर्न आग्रह गरेको छ। नयाँ राजनीति समीकरण बनाउने प्रयासका रुपमा यसलाई हेरिएको छ। बैठकले माओवादीले एकलौटी रुपमा प्रधानसेनापतिलाई अवकाश दिएर गैर संवैधानिक काम गरेको ठहर गर्दै राष्ट्रपतिलाई ध्यानाकर्षण गराउने निर्णय पनि गरेको छ।

बैठकपछि  १७ दलका प्रतिनिधिहरु राष्ट्रपतिलाई भेट्न शितल निवास पुगेका थिए। भेटमा राष्ट्रपतिले दलहरुको निर्णयलाई गम्भीर भएर हेरेको बताए।

एमाले केन्द्रीय सदस्य तथा स्थानीय विकास मन्त्री रामचन्द्र झाका अनुसार  बामदेव गौतमले बालुवाटार पुगेर  प्रधानमन्त्री समक्ष एमाले मन्त्रीहरुको राजीनामा बुझाएका छन्। राजीनामापत्र लिएर १७ दलको बैठकस्थलबाट बाहिरिएका गौतमले संवाददातालाई कुनै प्रतिक्रिया दिन मानेन्।

उता, प्रधानसेनापति कटवाललाई अवकास दिने मन्त्रिपरिषद्को निर्णय कार्यान्वयन गर्नु पहिले राष्ट्रिय सहमति जुटाउन राष्ट्रपति रामवरण यादवले प्रधानमन्त्रीको ध्यानाकर्षण गराएका छन्। राष्ट्रपति यादवले प्रधानमन्त्री पुष्पकमल दाहाललाई आइतबार अपरान्ह एक पत्र लेख्दै यसअगाडि आफू प्रधानमन्त्रीबीच भएको सहमति कुराकानीमा ध्यान नदिइएको तर्फ असन्तुष्टि व्यक्त गरेका छन्। राष्ट्रिय सहमतिबाटै निर्णय गर्ने त्यसअगाडि आफूलाई जानकारी दिने भन्दै प्रधानमन्त्रीले दिलाएको विश्वासमा घात भएको तर्फ राष्ट्रपतिले प्रधानमन्त्रीको ध्यानाकर्षण गराएको हो।

यसैबीच मन्त्रिपरिषद् बैठकले बर्खास्त गरेका रुक्मांगत कटवालले अवकाशको चिठी बुझेका छन्।  उनले यसअघि चिठी बुझ्न अस्वीकार गरेका थिए। यसैबीच कामु प्रधानसेनापति मुकरर गरिएका कुलबहादुर खडकाले उपत्यकामा रहेका रथीहरुसित छलफल गरिरहेका छन्।

मन्त्रिपरिषद्को निर्णयअनुसार कामु रक्षा सचिव गणेशराज जोशी सहसचिव श्रीधर पोखरेलले जंगी अड्डास्थित सैनिक सचिवालयको कार्यालयमा चिठी बुझाउन जाँदा कटवालले बुझ्न अस्वीकार गरेका थिए।   कटवालले कानून व्यवसायीसँग परामर्शपछि चिठी बुझे।

उता सेनापतिको बर्खास्तलाई लिएर विभिन्न स्थानमा विरोध समर्थनमा जुलुस निस्कन थालेका छन्। माओवादीहरु सरकारी निर्णयको समर्थन कांग्रेसलगायतका दलका भातृसंगठन भने विरोधमा उत्रेका थालेका छन्। सरकारी निर्णयको विरोधमा नेविसंघले निकालेको जुलुशलाई माओवादीले त्रिचन्द्रबाट लखेटेका छन्।

यसअघि भएको मन्त्रिपरिषद बैठक सत्ता साझेदार एमालेले बहिष्कार गरेको थियो भने फोरमले निर्णय प्रक्रियामा असहमति जनाएको थियो। 

बैठक सकिएपछि प्रधानमन्त्रीले कटवाल खड्कासँग केहीबेर कुरा गरेका थिए। त्यसपछि खड्का पहिले कटवाल केहीबेरपछि त्यहाँबाट बाहिरिएका थिए। मन्त्री परिषद्को निर्णयबारे राष्ट्रपतिलाई जानकारी दिइसकिएको तत्कालै एक मन्त्रीले बताएका थिए।

मन्त्री परिषद्अघि बसेको पाँच दलको बैठकमा सहमति नभएपछि माओवादीले एकल निर्णय गरी प्रधान सेनापति हटाएको हो। यो बैठकमा प्रधानमन्त्रीले मन्त्रिपरिषद् बैठकले प्रधान सेनापति हटाउने जानकारी दलका नेताहरुलाई गराएका थिए।  मन्त्रिपरिषद्को बैठकले सैनिक ऐन २०६३ को धारा ११ को उपदफा अनुसार प्रधानसेनापतिलाई बर्खास्त गरेको जनाएको छ।

संविधानमा व्यवस्था भए अनुसार कदम चाल्न राष्ट्रपतिलाई आग्रह
विपक्षी कांग्रेस सहित संविधानसभामा प्रतिनिधित्व गर्ने १५ दलहरुले प्रधानसेनापतिलाई बर्खास्त गर्ने सरकारी निर्णयको भर्त्सना गरेका छन्। कांग्रेसले डाकेको सर्वदलीय बैठकपछि उनीहरुले संविधानमा व्यवस्था भएअनुसार कदम चाल्न राष्ट्रपतिलाई आग्रह गर्ने निर्णय गरेका छन्।  १७ दललाई बोलाइएको बैठकमा एमाले फोरम भने उपस्थित भएनन्।

अविश्वास प्रस्ताव ल्याए सामना गर्छौं : भट्टराई
अर्थमन्त्री बाबुराम भट्टराईले सरकार ढाल्न विपक्षी दलहरुले अविश्वास प्रस्ताव ल्याए सामना गर्ने बताएका छन्। प्रधान सेनापति हटाइसकेपछि राजनीतिक सहमति जुटाउन पाँच साना दलसँग भएको बैठकपछि सञ्चारकर्मीसँग उनले एमालेले आवेगमा आएर सत्ता नछाड्ने विश्वास व्यक्त गरे। बैठकमा नेकपा एकीकृत, नेपाली जनता दल, नेकपा संयुक्त, राप्रपा नेपाल सद्भावना पार्टीको सहभागिता थियो।

निर्णय गैरसवैधानिक : कांग्रेस
नेपाली कांग्रेसले सेनापति बर्खास्त गर्ने निर्णय गैरसंवैधानिक बताएको छ। सत्ता साझेदार दल बाहिर रहेका सबै दलले विरोध गर्दागर्दै पनि संविधान कानुन मिचेर एकलौटीरुपमा माओवादीले गरेको यो निर्णयको विरोध गरिने जानकारी कांग्रेस केन्द्रीय सदस्य प्रकाशशरण महतले दिए।

स्थायी समितिको सरकार छाड्ने निर्णय
विकसित घटनाक्रमबारे छलफल गर्न नेकपा एमालेको स्थायी कमिटीको आकस्मिक बैठक पार्टी मुख्यालय बल्खुमा बसेको छ। बैठकले राजनीतिक सहमितिबिना प्रधानसेनापतिलाई बर्खास्त गर्ने सरकारको निर्णयप्रति आपत्ति जनाउँदै सरकारबाट फिर्ता हुने निर्णय गरेको छ। स्थायी समिति सदस्य बामदेव गौतमले भने सरकारबाट बाहिरिने पार्टीको निर्णयमा नोट अप डिसेन्ट लेखेका छन्।

नेविसंघद्वारा विरोध सुरु (मध्याह्न १२१५)
नेविसंघले प्रधानसेनापति हटाउने निर्णयविरुद्ध काठमाडौँको त्रिचन्द्र शंकरदेव कलेज अगाडी टायर बालेर प्रदर्शन गरिरहेको छ। सडकमा टायर बालेर प्रदर्शन गरिएका कारण राजधानीको ट्राफिक व्यवस्था अस्तव्यस्त भएको छ। यसअघि शनिबार कांग्रेसले आइतबारदेखि भातृ ंगठनहरुलाई सडकमा उतारेर जनदबाव सिर्जना गराउने निर्णय गरेको थियो। पुतलीसडक क्षेत्रमा उनीहरुले टायर बालेर विरोध जनाएका छन्। जसबाट सवारी आवागमन प्रभावित हुन पुगेको छ।

माओवादी छापामार तयारी अवस्थामा (मध्याह्न १२१९)
कैलालीको तालाबन्दस्थित माओवादी लडाकुको सातौँ डिभिजनका कमाण्डर प्रज्ज्वलले  उत्पन्न हुनसक्ने परिस्थितिको सामना गर्न आफूहरु तयारी अवस्थामा रहेको बताएका छन्।

राष्ट्रको गम्भीर जिम्मेवारी काँधमाः राष्ट्रपति  (दिउँसो ११२)
सागरकुमार पाठक अध्यक्ष रहेको नेपाल नागरिक समाजका प्रतिनिधिसितको भेटमा राष्ट्रपतिले आफ्नो काँधमा राष्ट्रको जिम्मेवारी आएको बताएका छन्। समाजका सदस्य बहादुरसिंह बिष्टका अनुसार राष्ट्रपतिले सबै कानुनी सल्लाहकार पार्टीहरुसँग सल्लाह गरी ठोस निष्
