If any H1 B gets married, what r u the option by which his wife can start working ASAP.

betterNepal..what i think is after getting married..your wife will be dependent of your current status.i.e H1B n i guess dependents are not allowed to work..you could contact some attorney for better knowledge...tc

 

you don't have to contact attorney here.....if h1 gets married ....his dependent will be in h4 (assuming she is not gc holder or citizen).....and h4 can't work.....

What if the person on  H1B is waiting for GC?In a condition his/herI40 has been approved and i485 pending and EAD on hand.

I was told that if anyone get married in that(I485 PENDING) status, spouse will also receive EAD (The Immigration officer told me during GC interview.) I am still not sure and no idea what kinda forms need to filed and how long its gonna take to get EAD. I know once the 485 is approved /GC received then its a lenghty process to get GC for a spouse.

Has anybody being through this status?  Please share..

If you file H1B , your spouse can apply for H4B. Since H4B is not allowed to work, she can not even apply for SSN too. She can apply for work authorization just  before she gets GC, thats a lengthy process. Thats why I suggest you not to marry any person thinking that the individual can get work authorization.

One more thing ,related to this topics. Since she can not work she will demand you hi-fi life as you start working as a H1B. If you just get H1B through Dhoti- consultancy and suffered a lot without getting a job. In most the cases they will revoke your H1B and you have to fight for status.  Then she will get depressed and your marital life could be ruined.
