I've heard conflicting information, so wanted to put it here to see what you guys think. Can a US citizen Nepali own property in Nepal? If so, can they purchase new property or only keep the inherited ones? How about the "id" for NRN that was being proposed? Thanks.

Do not ask and do not tell theory is applied. You should travel via Delhi and get a separate ticket from Delhi to Kathamdu. but you have to be careful about your luggage. You enter Nepal with Nepali passport and while you exit you will fly to Delhi in Nepalese passport, from Delhi you will fly with US citizenship.Sorry, that is what most Nepali holding US citizenship are doing, sorry to ask you to lie.

Majja le rakhna paucha. Even though NRN don't have dual citzenship but in Nepal all you need is NAGARIKTA. you dont need passport to buy or sell houses.

Syanjali ! Please dont give false information regarding traveling through India please if you dont know .... Omaha guy , dont even think of travelling to Nepal through India thinking you would use your nepali passport to get into and then US passport to travel back to US until unless you have a Visa for India , which cannot be received at Port of Entry .Us citizen's need to get the tourist visa prior to travel ,unless you plan for transit inside the airport . Anyways ! on your question , You can buy vehicle under your name but cannot invest in real state until unless you have a registered business that show's the transaction of atleast 16,000 US $ , with your Passport having a business Visa . My recommendation would be , if you still hold your Nepalese citizenship , like i do , Just go ahead and use it and try not to brag about what you have done . Keep a low profile and be careful on what you speak and disclose ... I hope this information helps ....

Saathi, be careful. U can hold the property untill somebody not complaining. Nobody can hold the property without the citizen n by law we can't hold 2 citizen n passport. So, that is totally illegal.

It's true .. according to Nepalese law.. a Nepali citizen cannot hold another citizenship.. if you have US citrizen or other country's .. then Nepali law expect you to surrender your nepali citizenship.. which means surrendering your passport and nagarikata... but not many have done it so.. probably, Upendra Mahato has surrendered and other NRNs who are rich. By law, if you are reported to be holding two citizenshps and then Nepal Govt decided to take action, you could be put into Nepalese jail for 20 years... That's a law. Yeah, the punishment sounds very tough... don't know why they put such law in place.. perhaps without thinking much about it.... but so far, none of such individuals have been prosecuted. If you have parental properties to be anshabandha in Nepal.. and if you have your brothers and bahujus.. then be careful with those bahujus.. they are the ones who would probably jump into reporting your status in order to strip you from your properties. I know this is a big hassle.... that's why now NRN is fighting for dual-citizenships so that they can get their share of the parental properties in Nepal. This is one of the biggest reason why NRN members are so actively fighting thorugh various associations... otherwise, no one would be joining NRN associations, believe me. But as an NRN, you can still keep a piece of land, area dependent on where (Kathmandu, mountain or teria) and probably a small house. But to make it legitimate, you need to have NRN card, again to do this you have to surrender your nagarikata. So far, foreign citizenship holder are still going to Nepal using foreign pasport.. Nepali passport cannot be used.. coz once they enter Nepal with Nepali passport, they cannot fly back. They are trapped in Nepal. But still buying/selling properties in maalpot offices in Nepal using their nepali nagarikata is ongoing... Well, until someone reports/complains... this seems OK.. but as I said earlier, when time comes, your own relatives will report against you when they see the opportunity of your property automatically transferred to them (aputali case). My advice is this: Try to go now and try to get your chunk of share with amicable negotiation with your brothers through anshbandha, After that. you could sell your properties and bring your money back to USA. In that way you will have no tension left regarding properties issues. In my case.. I am not going to claim anything.... and not going to ask anything... it's up to them what they want to give me.

Another thing to remember is... there's no case yet that anybody who travelled via TIA (who has nepalese as well as US citizenships) carrying US passport has been nabbed by the immigration for the purpose of persecuting.... There's no record as such.. afterall, as soon as they nab one such ex-nepali, it would have huge impact on for Nepal and the Govt. - both monetary reason as well as the hassle Nepalese govt will have to deal with US diplomatic pressure. This is not going to happen. Be assured.. so simply go to nepal carrying your US passport.. pay the required visa fees and Nepal is happy to take that visa fees plus your nepalese relatives are also happy to get some free gifts from you. And additionally you would be contributing to your former country anyways by spending some green dollars there in Nepal.. Now if your borthers and bahujus are trying to blackmail you so as not to give you fare share of your parental properties... Tell them to think twice... because as soon as they go and report against you about your dual citizenship, Nepal will have to take action against you by throwing you into jail for 20 years.. ask your relatives if they want you to rot in the jail.

Here are the things regarding the right to own properties in Nepal. According to the present law, Only Nepali Citizen can own a real estate property in Nepal unless, as Executioner says, you have a special business or other special category visas. So generally a foriegn National can not own a real estate property in Nepal. Since Nepal do not have dual citizenship, as soon as you become American or other countries' citizen, you loose Nepali citizenship, and hence you become a Foreign National as well. Having said that, if you go to Nepal and you want to do the closing of a real estate in Malpot Office, all they require is to submit a Nagarikta. Since Nepal do not have any "organized system" and relaxed attitudes of bureaucrats, an attitude of "lets just finish the work", you very well can take advantage of this system and do buy and sell of properties ( I am guessing that you still keep your Nagarikta). But rememeber you are taking risks of getting caught since these transactions are purely illegal. Once you come under the radar (like some one here mentioned if someone complained), you might loose everything or could be jailed for "imposing as a Nepali citizen and falsifying to a government officer" since you are not a Nepali Citizen anymore. I hope this helps your question. And oh by the way Upendra Mahato is still a Nepali Citizen and Nepal has promised to give NRN's 10 years ID, which allows us to come and go in Nepal anytime without visa requirements and possible owning property rights as well, but these are under construction in new Constitution. And for those people who are doing thast "tricks" of going through India, GOOD LUCK. Hope you know the consiquences if you are caught, these are not a Joking Matters. JL.

Executioner: Not trying to give any false info , this what I heard from my friend. While you go to Nepal from Delhi, you will show the Nepali Passport, you are through. Flying back you will check your baggage up to Delhi and from Delhi, you will fly with US passport. If you have to take visa to Delhi, you should do it.

Though a lot of people in the USA normally say "I don't care about NRNA"--but probably it is time to thank Upendra Mahato, for what he is doing will be helping these US based NRNs immensely. Sure, you can fake your way into selling the land, and may even get away from it. You can also probably get the money out of the country. But the best way is legal way. Join some organization, lobby for your right, and you can legally own and sell property in Nepal. It will also probably make you pause for a while, and you may want to invest in Nepal, and take only your profit out of Nepal. Or who knows, you may decide to live there once you realise that the Maoists also no longer want to wage people's war anymore. So, friends, join NRNA, get your rights, and do things legally. Interestingly, most of the NRNA leaders I met actually hold Nepali nationality even though they are living abroad for decades, and some are only holding greencard (consciously chose not to take US citizenship).

Yeah cleverer ones never took foreign citizenships.. they remained with nepali citizenships and thus carrying nepali passports for travel. And these NRNs are fighting hard for dual citizenships through various these NRN association.. you know why? As soon as they become successful in securing dual-citizenships for NRNs, the next day they are going to apply for foreign citizenships !!!!! And those who already took up foreign citizenships are doomed as for now.. until dual citizenship crtiterion is accepted by Nepal.. Therefore, both NRNs (NRN with nepali citizenship and those who already are foreign citizens) seems to be fighting for dual-citizenships. But I tell you what? Just because you guys took up foreign citizenship, doesn't not make you non-nepali Forget about law, you are still fugging nepali.. who once washed your ass after shitting with water and bare hands.. some on the railway tracks, some on the fields, some in the galli, some in the mountain, and some directly on the cauliflowers !!!

Most Nepalese who advocate for Dual Citizens in VA area are Nepalese who work at 711.... not sure how those people are going to help Nepal and Nepali folks back home when they can barely make their own living here. I have categorized groups who advocate for Dual Citizens in Nepal. 1. Folks who honestly believe that there will be lots of investments pouring into Nepal once Dual Citizenship bill is passed (as if there isn't any provisions for foreigners to invest in Nepal rt now) 2. Crooked bureaucrats and their offsprings abroad who desperately need Nepali Citizenship to claim their father's corruptly inherited property back home. 3. Deshdrohi leaders who also want another country's citizenship as a back up plan. 4. Most DV holders and Lahures who want to be able to easily sell their property in Nepal and bring it back to their second country in DOLLARS, big loss to the economy and Nepalese Currency 5. Lobbyist who work for India and its interest so that millions and millions of indians can get the dual citizenship by bribing corrupt Nepali official and make Nepal full of legal indians to help get Indian agendas passed. After all in all....seriously.... how many wealthy Nepalese are there abroad????...i have heard one in Canada( the one with a horny father in Nepal) and another in Australia ( the one who wants to open a university in Nepal)....and these two are worth approx 200 Million each. The rest are just 711 "Ghante Workers" they work for peanuts and save peanuts....nothing significant for People in Nepal to pressure their representatives to work on the bill. It seems like Nepal will have a chance of getting so little at the risk of loosing so much. BTW i am a GC here and i am applying for a citizenship soon. After i get my citizenship, if there is ever a need to get a Nepali Citizenship again, i will give up my US citizenship and get my Nepali Citizenship back. Sid
