one of my friend took a quater break and went to Nepal. Now the international student dept. of his College told him that his SEVIS cannnot be renewed. He needs to get new I20, new SEVIS and apply for VISA again from the US embassy in Nepal. His GPA is below 2 and he had a instructor withdrawal in one of his class. He had Health Issues so his GPA was low. He is in Nepal right now for treatment. His Community College has already issued him new I20, he applied for new Sevis already. Should he apply for VISA again (chances of getting VISA is low) or just come to US and take a chance at Port of Entry. One of my friend had similar situation, he took a chance at port of entry and got through with out any questioning. If any of you guys have had similar situation please give some suggestions. Any suggestions in this matter would be very appreciated. 

P.S. He has documents of medical report from here as well as from Nepal.

Hey man. .  I went to Nepal in december and my visa was expired, . . . so I had to renew my visa and then went to interview .. . . the lady was freaking kind of rude and was asking several questions. .. . but she was forced to give me  a visa as I am graduating in June, , , , and i had everything fine, i mean in status and alll . .. .  it would be difficult for him to get visa in my opinion. .. .  but thats on my opinion only ok . . . dont take me other way . . . on the other hand. . . most of the time the person at the port of entry doesnt have that much idea ..  for an ex. . in my port of entry . . i handed my passport and i-20. ..  ofcourse once you get the visa.. . the embassay they put a stamp and the date of visa issued  on the top of  i-20 on the right side of the front page.. ..  and she asked me who did that one .. . ..   she should  be knowing that thats the block where it says, visa issued from .. . . .

if his visa at the passport is not expired, it shouldn't  be a problem. no need to go to embassy again

Why do you want to go back to the embassy if the visa in the passport is not expired?

thats what i was asking about. he already has 5yrs visa. it expires on dec 2012.. 
he already has: new I20
new SEVIS (paid $200)... i dont know if its active or not
passport VISA is current... there is no rejection or deport stamp .. i mean its clean
if he already has all this, is there going to be any problem in PORT of ENTRY...

it might show them (immigration) that SEVIS is inactive, but he has active I20, SEVIS paid receipt and VISA... they might ask why its inactive... he can just say dont know right ??. and tell them that he had to go Nepal for emergency medical treatment. and now they had to issue new I20, SEVIS...

the main thing is the PORT OF ENTRY...  they might be stuck with why sevis is inactive... 
he already has every thing...
any suggestions...

About 20,000 applications for offshore migration received since September 2007 would also be immediately withdrawn.

SO IF YOU THINKING OF TAKING TRADE COURSE SUCH AS COOK HAIR DRESSER..etc think twice.. only university degree on specific course will be eligible to apply. (Must be in high demand list) ..they need to be hired.. and company need to sponsor them to be eligible to apply for a permanent residency.


Now dont' listen to agent goto australian govt immigration website and check it out


www.immi.gov.au ...( under migration)


there are 1000's of Nepalese, Asian studying those subject are in limbo.. either to join further course or find some one to sponsor( very hard..some of them are charging upto 35-45k) so consult ..think research apply

shrestha8, you or your friend ( I assume this person is nobody else other than yourself ) are getting all worked up for no reasons. If his GPA is less than 2, what are you expecting? Him to get a Visa? Just have him book a flight back. He should be fine.

Just come back you people or you be fine !! coz if visa in passport is not expired then you are 100% in and In PORT OF ENTRY if they ask you why your SEVIS is Inactive then just say same thing you said " it was an emergency treatment that i went to Nepal". Plus you have everything renewed so you don't have to worry. Lastly , try to move up you grade,  later you gonna be [Disallowed String for - banned word]ed up !
