hi i was giving a road test withthe DMV personnel by my side. while road test, i failed to stop at the stop sign on in a 4 way intersection( stop sign was only in the way i was going) then in the middle of the intersection the lady who was taking my test screamed i didnt stop at the stop sign i got nervous and stopped the car in the middle section whn a car coming from left direction hit my driving side door and front wheel. i called the cops and no one was injured he made a draft and gave me a citation for disobeyed traffic sign. So is there any way i can defence myself from not getting the fine and the demerits. What i think is i was giving the road test how many people give road test and fail, because they do mistake which is not following the traffic rules which mean every person giving road test and failing should get a ticket and the cops should have like huge patrol around DMV and get some money for the goverment ticketing the road tester , i unfortunately got in to accident and had a big issue. .it wudnt happpen and would be just a failure to stop sign if the lady didnt scream in my ear and i wud pass thru the intersection.for most she would fail me in the road test. i was in fair speed between 25-30 in the 30 limit road and stopped few seconds before the car hit me i think the car was at a higher speed although he didnt have stop sigin in his road. he was a local lived one block from where the accident happened. pLEASE SUGGEST ME AS MY COURT DATE IS MAY 17 2011

 Wait a min guys dont scare him. Nothing will happen bro , i had got similar situation. The only difference is that u stopped and got hit and i didn't stop  and got hit. I was little bit lucky than u that the car was backing up and i thot its not necessary to stop and i didn't stop though the exam taker said and i got hit. He called cops and gave me 250 bucks normal tickets on careless driving, there was normal court date of two month as like yours but i paid it before that so i didn't went for date and nothing else.  Its just simple case of an accident which ur insurance will take care. On mine i made them to pay though i paid for ticket. 
Of course there is your fault but not as much as u should be punished so bad ! You can go court and fight but there is no chances of yours to be safe since its all ur fault to not to stop on sign. 
If you are thinking to be safe because you were taking test and sombody screemed than forget that, even though you were taking test or not , its your fault to not to stop at Stop sign.

i am no lawyer but if i were you, i would pay the ticket, not contest the officer's citation, buy a six-pack for the evening. take driving lessons next time, produce credentials to prove that you did take classes, pass the exam and come home happy. chance my friend, makes or breaks a moment. it wasn't yours today. that is all there is to it!
oh yeah, by the way, when i first failed, the lady officer next to my seat said that i made a dangerous right turn, asked me to stop the vehicle in the middle of a heavy traffic and stomped out cussing! i know it feels bad.

Don't pay. Go to court. First timers get a break. Either your ticket will be dismissed by requiring you to take a driver's safety course or you will have to pay less.
If you pay without going to court, you lose the chance to tell your side of the story to the judge who will be kind enough for first time voilaters if they accept their guilt, and most importantly it will show on your drivers record that you had an accident and your insurance will go up. You must must go to court for long term good.

Example, my insurance without tickets per month 81. My insurance with few tickets 157 per month. Almost double. Don't make the mistake that I did by paying fines and not going to court. And you have an accident, that will skyrocket your premium. So, before you go before judge, take some professional driving classes and also driver safety class(also called defensive driving), I am 99% sure, he will dismiss your ticket. No lawyers required. A bit of hassle but saves you thousands in insurance costs.

furke, i understand what you say bro ! but read his thread there is clear case of violation of law and DMV officer is also on side who is considered more truthfull than us and as he said i dont think she goona say saomthing favor on him! In this case there is no way you goona be out without paying anything !
Btw here is not only matter of ticket also insurance ! Of course that car has took his insurance policy number, now you have to  prove his insurance that it was not your fault !! which is impossible in his case !

I also think it is better to go to court. Most judges consider first timers and you might be made to pay less after telling your side of story.

Or, try changing the court date - by doing that cop wont show up (most cases) in court on that date and you will win..

 Cops these days dont need to show up, and the case wont be dismissed. Go to court and try to only pay the fines and NOT THE POINTS. Tell judge the truth and everything that happenned, also the screaming part, if thats true. Hopefully you get out of this easy, And get drivers ed before you take another test bro.

I recommend you to do what furke said. At least go to the court and plead guilt with the judge and pay the ticket. That is a good way.

Yes, this cae is Failure to Stop at Stop sign ( Contributes an Accident).

It could be a lot of Points. May be 3 or 4 points.  Of course, there is a fine, too. But Points will remain on your record for certain years.

Since you'v received "citation with court date" YOU MUST  be present in Court  on that specific date. 

Court room is always busy and Judge has to decide most cases within 10 mins. 

Say,  GUILTY WITH EXPLANATION ( please read my email).

 If the police who wrote you citation fails to appear in the court, your case will be dismissed. pray for it. i hope you remember the cops face because sometimes different cop appears in the court pretending to be the who wrote you the citation.

Brother , though your both answer were  not for me , let me say you something. man makes mistakes , i did same as you did , we are on same boat but brother there are some mistakes which we have to pay in any cost. Your accident is same like that,, I am not like others talking without any points, i got same accident like you did so saying to you.
You might go to court take class remove from your driving history but what about that another car which hit you because of your mistake, of course he is not going to stay like ok lets leave him its first time !!!
