it's illegal.
but i believe in free software policy, so aayeko baat chhaina, je pani download garinchha - from songs on youtube to pdfs of books!

Yes it's illegal uploading and downloading both . But there is very less chances of getting in problems depends where you download from .

It depends upon what you are downloading from the torrent.
You cannot download copyrighted contents from the torrent or elsewhere.
However it is 100% legal to download open source/free software from the torrent.
For example you can download Fedora from http://torrent.fedoraproject.org/ using a torrent software.
