A 22-year-old food delivery man who raped a half-asleep customer in her home has been jailed for three years.

Amit Hamal was delivering Indian food to the woman in the eastern Sydney suburb of Rose Bay, but when he arrived he found the door ajar and her husband asleep, a Sydney district court heard.

When Hamal walked past the woman's bedroom and saw she was asleep, he went in to her room, took off her pants and raped her.

The woman asked her husband about it the next morning, assuming she had had sex with him.

He denied having sex with her, saying she must have had a "vivid dream".

But when Hamal called the house later that day and suggested to the woman they become sexual partners, she realised she had been sexually assaulted and reported it to police.

DNA tests confirmed Hamal had raped her.

During the trial, Hamal told the court the sex was consensual and that she pulled him towards her.

The Nepalese-national will serve at least 18-months of his three year sentence.

Old news brother.
What got him in the trouble was the fact that Mr. Hamal tried to flee the country, which jury took as admittance of guilt.
