Hey folks, if you have any experience,please share if there were any trapping points where you may get trapped in the name of Green card Processing.And how can we avoid such a situation.Any helps are highly appreciated.

I am Man....Big time...My I 40 is approved...waiting for I 485...I was told that I 40 cannot be transferred..If I switch a company I have to start from a Scratch...So I suggest, Think before filing GC, go for it if you are sure that you are gonna be there for next 4/5 yrs...Good Luck

Thank you Net Freak for sharing.Can't you immediately apply for I 485 once your I 40 got approved? Does it take 4/5 years for GC processing?It is a long time.Could you please elaborate time frame if you don't mind?

if you are filin under eb3 then u have to wait for 3-4 years. else it will be current.but to qualify for eb2 u have to show that ur jobs require master degree or bachelor and five years of experience. hope it helps

NIRAVANA75062 ,thanks for your input.So far my understanding,there are 3 steps in GC processing: 1) Labour Certification:hrd that it is a property of employer and you can not claim it. 2) I 40 3) I 485 Among these three steps,after which step,employee is safe and can not get trapped by employer ? Any inputs are highly appreciated.

H1B, You can get trapped if you file under EB3 category. You may get to I-140 pretty fast, but There's NO WAY you can file I485 (AoS) for 6 or 7 years. EB3 category for Nepal is stuck at Aug 2002 since last October and it hasn't moved at all until now. So, you can project how long it will take if you file today. SO BE AWARE OF EB3. Try to file under EB2 and get your PR within a year or so. Net Freak, You and me are on the same boat:)

Thanks batuwa for your input.Yes,I will be applying for EB2.Once I-140 got approved through company,may be company is not willing to file I-485 immediately,right? That's what I thought.

i heard that eb3 date will move fast after this summer. may be in the fall. but till then it will not move. so safest option is to file under eb2 but u have to be qualified for that option.

H1B, Remember one thing: you can legally file multiple gc applications from multiple companies because gc is for "future employment" and you're not required to join them until you receive the green card physically. If your current employer doesn't file, then you can file from other employers as well. Nirvana, What's the history of EB3 date movement? My I140 was approved in last Oct 2006 and I haven't seen it moving since then. One can imagine when I will receive the gc if it moves one month within every 6 or 7 months. eheh!

I don't think I140 has any portability. But you can switch your employer after filing I485 that has 21 centuary 180 days portablity rule.
