 Birth certificate for I-485

Hi all,
I have question for the requirement of the birth certificate to file I-485 for GC application. Since I dont remeber having or using birth certificate ever for anything yet and since I was born in a remote village I dont have one.
In that situation, does the citizenship is going to work or not? or is there any other document I should have.
Please suggest if somebody has gone through the process and used some alternatives for the birth certificate.

Its better to get the birth certificate. You can ask your folks/relatives to get one made for you from your village. If you cant get one, you can also have affidavit of birth certificate from someone who witnessed your birth. There is no particular format to it but he/she can write a letter to USCIS indicating that he/she knows when you were born based on personal relationships and that there was no custom to register births at that time in your village. Please make sure to have that letter notarized from the public notary. This should suffice if you dont have birth certificate.

Great help.

Getting birth certificate may not be a possiblity for me, born in home (no hospitals) in a village. If I try to get it from village district, it may take months.
Affidavit looks an option, please let me know if notarizing from Kathmandu distrtic office (showing my original citizenship) and affidavite form my relative living in kathmandu (they know about my birth) is going to work.
Never realized I may need one, now time factor is killing me.

The nepalese embassy can make one for you if you send them a letter with $25 money order and copies of your passport or nagarikta.

You mean they can make me a birth certificate? what kind of letter should I writte? Please let me know in some detail.

Just write to them asking them to please make you a birth certificate. That's all, or first call them, you will need to send it through registered mail with a self addressed return envelope which should also be registered. Call them first, google search them for phone number and address.

US embassy at DC and do that for you. Check there web for details.

I heard that now USCIS will not accept any birth certificates that made by office like embassy in US. Check with your lawyer first. It is easy to make in Nepal you can ask to VDC sachib to make it in just letter head of VDC explaning that you born in this days. One more important thing you need your mother and father name mentioned in Birth certificates .Usually in nepal they put just father's name. and translate it in ktm. USCIS will not accept if there is only father's name.

Hey guys,
I was able to make a birth certificate from municipality office but lawyer is saying it might not work, unless i have a non availability document. I have also read about affidavit of birth documents that will be required if so the case. Can you please shed some light on this issue? will the municipality letter not work by itself? Lawyer is ready to submit it but I don't want them coming back wiht further requests of evidence.

As I heard, the statement of Saan Dai is true. USCIS will no more accept the birth certificates issued by Embassy. I have my birth certificate issued 4-5 months before. But the lawyer says that doc is not sufficient. I need to affidavit of birth certificate. My parents can not read and write English. When I mentioned this to lawyer, he said they can sign in Nepali and then trnslate the document in English (Jhanjhat ko Kaam!!!). Also he mentioned that it need to be signed by a Notary Public. Who could be a Notary Public in Nepal? Govt Officers???? I think their commision do not expire like here.

The Birth certificate issued by municipality should be ok if it is written in English. My birth certificate was from municipality too but in English. INS did not object on it.

u could do it at the American center.. the place u register for toefl.. they charge u some money .. i think rs 200 or something for each page.

I don't think we have something called public notary in Nepal. What I did was, notorized by government official in Nepal with stamp, signature and post. My lawyer said its okey. And if you remember, anywhere in Nepal if we need to submit documents, we have to certify from government official of Nepal.
