College Students With Temporary Protection Status (TPS)

advantagesPart of American college campuses being melting pots entails students not only having different nationalities, but also different citizenships. As U.S. Citizenship and Immigration Services describes, as part of a humanitarian mission, the United States created a temporary protected status (TPS), which allows citizens from certain unsafe countries to temporarily and lawfully remain in the U.S. and even work here.

TPS Student Rights
When considering college, a TPS student may have numerous important questions, such as:

Am I permitted to attend college?
If I attend a state college, will I qualify for in-state tuition?
Do I qualify for federal financial aid?
College Admission
Immigration law and education law are separate entities, but a student with TPS status simultaneously triggers both of these legal areas. TPS students are best advised to contact colleges of interest to learn if they are eligible for admission. It is important to note that there is no federally imposed bar to college admission for TPS holders.

Eligibility for In-State Tuition
The first factor in paying for college is the tuition cost. State schools offer lower in-state tuition to state residents. As the Washington Post has reported, some states, including Virginia, permit TPS students to pay in-state tuition fees at state colleges. Prospective students who are interested in matriculating at a school within their state college system should contact the school to learn if TPS status holders are eligible for in-state tuition. If so, the prospective student will also need to satisfy the school’s residency requirements.

Federal Financial Aid
According to the 2011 – 2012 Federal Student Aid Handbook, in order to qualify for federal financial aid, a student must either be a U.S. citizen, U.S. permanent resident, or eligible non-citizen. TPS holders are not considered eligible non-citizens and therefore do not qualify for any federal aid, including grants and loans.

State Financial Aid
In general, states require students to be a U.S. citizen, permanent resident, or eligible non-citizen in order to receive state aid. TPS holders do not meet the immigration status requirements for state aid. TPS students are best advised to contact the financial aid office of their home state schools and inquire if there are eligible for any other funding resources.

Schools are aware of how immigration status can limit financial aid options and may have developed strategies to assist non-citizen or non-permanent resident students. Some private colleges may provide scholarships to TPS students, an option which should be considered and explored.

Borrowing a Private Loan
Similar to international students, TPS students who attend eligible U.S. schools may apply for a private loan to finance college. A cosigner will be required. An eligible cosigner will need to be U.S. citizen or non-permanent resident and meet the loan’s creditworthiness criteria.

Exercising Your Right to Work
An essential benefit of TPS is that holders have the right to apply for the employment authorization document (EAD) and lawfully work in the United States. The right to work and earn an income, coupled with lower in-state tuition (where applicable), means that TPS holders can potentially self-finance their college education. One huge upshot of this strategy is that you will not graduate with student loan debt.

For students, F1 and TPS are two different processes.Just keep in mind, TPS is rarely revoked after 18 months period. So it can be a lifeline ! MTC GL

You raised a very very genuine issue. Nobody here seem to care about what will happen to people who were traveling to Nepal during the quake. Please, think about how they will benefit. Perhaps a campaign for an extension to what they are planning to approve. Just a thought. Thanks

@urban_khasi What i am trying to say is ..suppose I am currently in legal status and traveled to Nepal but when I was in Nepal, earthquake happened. Now I came back to US again. Can I benefit from this since i wasn't present in US during that period. TPS is not only for illegals.

@ deepocean, Yes you can if your GC is about to expire can you cannot extend it anymore or cannot file for Citizenship.

I had my H1 approved this year but am waiting until Oct to start. I know you have to get stamped to enter USA if I travel to Nepal under H1 but can I apply for a travel document under TPS ?

It all depends..if you have a job offer in hand ...better quit school and work until TPS expires then apply again for school when your TPS is about to expire....if you don't wanna work and avoid application hassle..its better to stay in school and work in campus...TPS is mostly beneficial to illegals and people whose EAD is about to expire.

Yes, the question is if you quit school, can you apply back to F1 once TPS expires. They clearly say no, you need to go back to your country. I am not sure how F1 will be reinstated once you drop. You need go back your country and apply from there? Who knows, I am trying to go in depth.

Definitely, it doesn't cancel F1 but if you use EAD from TPS, you will not considered as F1 student, so you loose your F1 status because F1 student and TPS are completely different things. TPS will protect you but the immigration status should be maintained yourself, if you fail to continue to current immigration status, TPS still protect you but seems you cannot comeback to original immigration status once TPS ends.

In addition to the extension and re-designation of TPS for Haiti, DHS has taken a number of other actions to provide humanitarian assistance to Haitian nationals in the United States. DHS will soon publish a notice in the Federal Register announcing the continued suspension of regulatory requirements related to certain F-1 students who have suffered severe economic hardship as a result of the earthquake in Haiti. Originally announced in September 2010, the continued suspension of these requirements through Jan. 22, 2013, allows eligible F-1 students to obtain employment authorization, to work an increased number of hours during the school term, and if necessary, to reduce their course load while continuing to maintain their F-1 student status. F-1 students granted employment authorization will be deemed to be engaged in a full course of study if they meet the minimum course load requirements.
