Shiva has been in languishing in jail for a month and meanwhile, not much has happened. Due to his being in a ward where he was not permitted to call out for over two weeks, as a result of which his phone connection was disabled, he was unable to contact me until last weekend after the connection was restored. He is understandably apprehensive of his November 10^th arraignment and, rather unhelpfully, his Public Defender has not been in touch with him or available for some time. It appears imperative that outside counsel has to be retained and soon. 

Unfortunately, our fundraising has stalled at about $5,500, an amount inadequate to retain credible legal services. He has asked me to send a special appeal to his friends to help him in his hour of need. Before anyone gets the impression that this is an appeal for funds to be used for his prolonged legal expenses, let me clarify that the intention is to get a current one-time resolution in his case that positions him to continue the case on his own.  I will not go into the options or the possible legal ramifications here but suffice it to say that retaining qualified counsel is the best way to help him at this time. He realizes that and stresses it repeatedly in his calls to me. 

I think it is time for his friends and countrymen to step up.

As some people may think he is a doctor and might have lots of money. This is not true.Dr Acharya is from Padampur Chitwan and went through a big struggle in his career. He has always remain simple and his ultimate aim was to do something for the nation and Chitwan. He had just completed his 1st year of Internal medicine in St John hospital in Chicago. Recently had gone through an intense personal stress and was very depressed and was not in a state to act normal. That is the main reason for this incident and anybody can realize that no normal person does what he did.

     EVERYBODY MAKES MISTAKES . THING HAPPENS SOMETIMES EVENTHOUGH YOU DONT WANT IT. IF HE WAS A GOOD GUY, HE WOULD NOT HAVE LEAVE THE ACCIDENT SCENE.  HE WOULD HAVE CALLED 911 AND CALL FOR THE HELP. BEING DOCTOR, HE SHOULD HAVE TRIED HELP THAT POOR GUY RATHER THAN HIDING IN THE BUSH.

EVEN A 10 YEAR OLD KID KNOWS THAT HE/SHE NEEDS TO CALL AMBULANCE IF SOMEBODY IS HURT IN ACCIDENT!!!!!

AND IF HE HAD INTENTION TO SERVE NEPALESE, HE WOULD HAVE NEVER COME TO USA.HE WOULD BE IN SOME SMALL TOWN OF NEPAL HELPING NEPALESE PEOPLE WHO NEEDS SOME GOOD DOCTOR. NOW DONT TELL ME THAT HE HAD AN INTENTION TO GO BACK TO NEPAL AFTER 10 YEARS!!!!!!!

AND AT LAST, IF HE CAN AFFORD DRIVING BMW THEN HE CAN ALSO AFFORD FIGHTING HIS CASE. WHY DOES NOT HE SELL HIS BMW, USE HIS CREDIT CART TO CLEAN THE MESS THAT HE CREATED.

AND WHY ARE WE RAISING MONEY FOR HIM KNOWING THAT ALL THE ODDS ARE AGAINST HIM????????THERE IS NO WAY WE CAN GET HIM OUT OF THE JAIL!!EVEN THOUGH IF U GUYS GET HIM OUT OF THE JAIL, WHAT IS HE GOING TO DO? DRINK AND DRIVE???

OR THAT $5500 CAN BE USED FOR THOSE KOSHI VICITIMS OR TO THOSE NEEDY PEOPLE IN BIR HOSPITAL WHO DONT HAVE MONEY TO BY ANTIBIOTICS WHICH CAN SAVE THEIR LIFE.

You started the thread with information that people could not believe like "He has always remain simple". Driving BMW doesn't prove it.

Also, I agree with the statement "his ultimate aim was to do something for the nation and Chitwan" because every nepalese around the world has wish to do something for their country. But, it doesn't suit to write here because everybody knows he was a doctor at Nepal and he came here for earning fortune. Even though many other people did the same, doctors are viewed as very important asset of a country and people tend to think they are from wealthy background who can afford to to come to US. 

Basically, I just wanted to point out that the way you have pledged for help will have negative effect on collecting fund.

WOW!!!  I had to put my 2cents... it is unfortunate that he hit someone and ran away... it is the first thing that comes to someone's mind, is RUNN run forest run..

1.  I gather that he has a small child. The victim who died has a dependent teenager. Should we look into helping these dependents also? Pardon me if I am straying from your objective for the appeal.

2.  You mentioned “It’s time for his friends and countrymen to stand up”.  As a fellow countrymen I take it that you have challenged me to ‘stand up’. I understand that you are challenging me and people alike to stand up to our responsibilities? Can you please clarify what that responsibility is? Remember I also have responsibility to uphold the law and enforce it. Please remember that collective life of a society and laws that enable it also equally important. Please help me understand the situation and present your most fair and objective assessment. I shall then oblige.

He has always remained simple.’ Down here simple people don’t have a new BMW. Please clarify if he was the owner of the new BMW that he was driving at the time of accident. If he never owned that BMW, I am willing to contribute what little I can.
