Most of you already know what happened with him last month. There are various angles to comment. But at this time he needs help. Chicagoland nepali pariwar is co-ordinating the fund raiser- www.cnpariwar.org which has a pay-pal link
Shiva has been in languishing in jail for a month and meanwhile, not much has happened. Due to his being in a ward where he was not permitted to call out for over two weeks, as a result of which his phone connection was disabled, he was unable to contact me until last weekend after the connection was restored. He is understandably apprehensive of his November 10th arraignment and, rather unhelpfully, his Public Defender has not been in touch with him or available for some time. It appears imperative that outside counsel has to be retained and soon.
Unfortunately, our fundraising has stalled at about $5,500, an amount inadequate to retain credible legal services. He has asked me to send a special appeal to his friends to help him in his hour of need. Before anyone gets the impression that this is an appeal for funds to be used for his prolonged legal expenses, let me clarify that the intention is to get a current one-time resolution in his case that positions him to continue the case on his own. I will not go into the options or the possible legal ramifications here but suffice it to say that retaining qualified counsel is the best way to help him at this time. He realizes that and stresses it repeatedly in his calls to me.
I think it is time for his friends and countrymen to step up.

As some people may think he is a doctor and might have lots of money. This is not true.Dr Acharya is from Padampur Chitwan and went through a big struggle in his career. He has always remain simple and his ultimate aim was to do something for the nation and Chitwan. He had just completed his 1st year of Internal medicine in St John hospital in Chicago. Recently had gone through an intense personal stress and was very depressed and was not in a state to act normal. That is the main reason for this incident and anybody can realize that no normal person does what he did.

Very sad news!!
What a way to die....Feel sorry for his baby boy and wife and ofcourse his parents.I was the one who without knowing him donated $10.I felt sorry for his little boy and just tried my best to help him out. Maybe he regreted and commited suicide.I didn't know him but once he realised what he did,maybe he was ashamed of himself.Whatever the reason,he shouldn't have done that.He made his family cry for him twice.What a waste of beautiful life .
Hope God will forgive him and may his soul rest in peace.......

HowardRoark, I concur a 100% with your statement...A Nepali brethren commits a crime he truly regrets and then turns to others in the Diaspora for even the tiniest support and the very peeps he has all his hopes on, turn the other way (What's worse is when some even go on to blame him for everything wrong in their lives). Damn, we Neps call each other dai-bhai even if we have no blood relations and when the time comes, we abandon the very essence the word "daju-bhai" mean. Just coz a dai/bhai commit a crime, isn't it disgusting that some amongst us go on to bring that dai/bhai down? C'mon, if thats the case, then don't even call any other Nep out there (not blood related) as your dai/bhai...And I know for a fact ALL Neps do it...If you cannot handle the sanctity of that word, then never use it to anyone except your REAL dai or bhai. Man, in times like these we should've morally support out Nepali brother even if he was wrong (moral support is all that would've done good to his situation)...We know he was wrong in trying to elude the police, but we also know that he did not run over the motor-cyclist on his own will: His car skidded and hit the unlucky bike. I'm sure tha the Chicago Pariwar trying to raise funds for Dr. Acharya visit sajha every now and then and when they see such words of anger against one of their own, I can only assume that Dr. Acharya must've been told about it or as famous as sajha is amongst the Diaspora, he too may've come to sajha and seen everything and everyone against him...Even the very peeps he thought his own. Imagine how much someone's morale can be affected by the pillars of hope (the Diaspora) collapsing against him??
I'm glad that the Himalayan Kid whose thread I opened last yr (on a hit and run charge) never ever visited sajha in his life. All the negativity here would've made him do something that would've left his loved ones devastated.
The Samsara's word of advice: When people come seeking for help, its better to shut da fugck up if you are unable to provide it. You were not present when the accident happened and you would never know the remorse that runs through the perpetrator's head. So, listen all you haterzz and ignorant azzfugks (casino, nepali_nepali, rewire, oksd, anignam, etc.) out there who think you're some kinda forensic expert without even being in the scene of the crime itself, keep your damn gob shut if you wanna start passing ignorant comments against ANY Nepali who come seeking your moral support. This is the USA, FOBs. No one here is guilty until proven in the court of law and Dr. Adhikari clearly was still awaiting trial, so I have no idea where you got your allegations from. Samsara that was some of the truest stuff I read on this site...Everyone has a godddam opinion on every case and they are so quick to vilifiy someone with that "holier than thou" attitude. This sort of thing can happen to anyone. Although I did not know Acharya personally, I doubt that he intended to kill the motorist. He made a foolish decision in trying to evade the police and this was the outcome. Imagine the guilt and remorse and despair that this man went through in jail. Just when he is entering the zenith of his life, he does not get to enjoy any of the fruits of his labor or take care of his family....instead he is sent to jail and not allowed to even keep contact with others via phone..I understand what he did was wrong and Keith Brown can never be brought back..but this was not a deliberate act of murder..and why the fuuuck is it so hard to give even the slightest bit of sympathy for the man and his family...Honestly, that "dai-bhai syndrome" that so many Nepalese are afflicted with bugs the hell outta me. There was this one dumbaas who was 5 years older than me and expected me to call him dai..I did outta respect...but none of the actions he showed warranted that title..if I was in trouble or needed something, he would never make an effort to go out of his way to help me..which is fine, that is his own prerogative...but why the hell he expect me to call him "dai"? There is no brotherhood there, and I doubt that there is even a true friendship there..

Although his demise is sad but still there is no excuse for what he did while driving. It wasn't an accident it is more of the case of murder. If you drive in 65 MPH road at 130 mph and kill a person then it is not considered an accident. And I request you people not to call that an accident. However, his death is still sad and I believe that prison should be held accountable for the negligence .

He made a foolish choice to outrun the police...his whole life was destroyed because of that one decision...you can call it whatever you want to...but show the guy some sympathy...he did not intentionally go looking to kill someone..only if and when you are in a similar position, will some of you be capable of being the least bit sympathetic..

There are many guys crying like they never get in trouble.I had written in this same thread before that if you aren't interested or are oversmart please shut your mouth. Samsara said it perfectly. In some gatherings too, I was argued with some oversmarts who were talking about US laws, the bike rider, the bad habits and blah blah without understanding his mental condition. I dont wanna curse to fellows for the same but I hope they will remember whenever they get in trouble.
Anyway it's very sad to know about his loss. A good friend, father, husband, son has been passed away. May the soul rest in peace and heartfelt condolence to beloved ones.

On HowardRoark's comment, I don't think "happy heart" would describe the general feeling here but I sure think the Karma caught up to the guy. Is it Sad ? Sure. Does this break my heart ? No. Doc was arrogant enough to outrun the cops in another state finally killing the biker and then trying to elude the cops. That tells you the kind of the person he was. I won't miss him.
And yes, Himalayan kid or should I call him the great Himalayan wanker, is another one of those scrweups. I am not going to support these murderers for just being Nepali. Fk them all...

I know in overseas a Nepalese should support a Nepalese. But we must also consider that we shouldn't support any criminal because we have responsibility towards the country that we are living. When you drive at 130 miles an hour in a road which is meant to be
driving at 65 mph and if you kill somebody than in law it is no more an
accident. They take it as a murder. And somebody was trying to justify by his mental condition. But arn't every criminal have some sort of mental disorder that makes them become maniac. And in this thread everybody is entitled to the opinion. You can't say shut up to others. When Shiva Acharya was alive many people did believe it was wrong to help him out because they thought he was a criminal. So those people were right to discourage not to help Shiva Acharya out. Its just matter of opinion. Yeah its sad he died and US prison should take accountability of that. I hope his soul rest in peace. Probably fund can be generated to send his body back to Nepal. But I have more sympathy for keith Brown than Shiva Acharya. Sorry I don't know history of Shiva Acharya or how good he was........but that is irrelevant when you consider this incident.

newlynew, What Shiva Acharya did was a crime, no doubt about that. And the criminal side of him should be discouraged. But you have to understand that he didnt plan to murder the man. He probably was already having some problem in his personal/professional life or was mentally unstable, and the accident pushed him to the edge. Only he and he is to blame for that and he is guilty and needs punishment. I am sure Samsara means the same. But he definitely didn't deserve a death just coz of that crime he did. He wasn't a professional murderer or anything like that, and after he got his cool- I am sure he regretted what he did. Just some moral support might have given him a different view to life, and he could have fought out of the misery and hopefully become a better man. Here at Sajha and in general, we Nepali have the habit of prasing or bashing someone to extreme for some reason. In reality though, no person is that great and no person is that bad either. It all about circumstances of life, and given enough hope and support I am sure even the weakest or the most evil person on earth can change for better.

Howard, I was merely supporting Dr. Acharya on seeing all the abuses hurled at him here and the older thread on the incident. He has still NOT been found guilty of the crime. The court-case was still pending and for some of the "presumptious" comments used against him were certainly not warranted. Once convicted, then it would've been different but at such an initial phase of the trial for any judgment to be passed is certainly not welcome in my books, especially of a person of such a stature (a medical Dr...And we are lacking of such educated folks here in the US). BTW, I have never met or seen Dr. Acharya but somehow there does arise a certain sympathy for him due to him being from where I was and being in the same struglle to make it here just as me. I can identify with him and felt it my every responsibility to defend him especially since he was never convicted of the crime!! And you're true about the feeling of schadenfruede that exists among some ignoramus here...I am ashamed of even identifying these hypocrites as being my own when they themselves commit petty crimes here in the US. Ain't that something!!
