So with Federal Notice set to publish today, do you think we should immediately apply for EAD and Advance Parole? or wait a few weeks? Suggestions are appreciated!! Thank you!

Thats what I think it is, I have send only EAD application form, still pending. Checks cleared. Biometrics waived.

In case of @natasha, pretty sure it's coz of the i821 that they said the amount was incorect. The guys who process don't use their head and are like chakko pilo, just makes your life difficult. They don't bother thinking twice. Just send i765 and not the i821 this time around. In case of @chabahil, they require a copy of your TPS approval, which in itself is a i797, from what I understand. If you've for that you just need to send the latest i797 for the i821 and you should be good. @pyackman: have you received your i797 yet, or any email sms notification where they provide you with the case tracking number?

Thanks so much guys! The reason I sent the i821 is just so I have that TPS approval paper along with ead.. I think to be safe I will send separate checks for the ead. $410, and $85. I remember they took that last time as well for me.. I wonder if I need the $50 for tps. they make this so hard as if it isn’t already hard enough for us folks here.. appreciate everyone’s help.

@jhilkedai: thanks bro. I sent the application for EAD with the I797A approval notice with valid date of 12/25/2016-06/24/2018 (1st reregistation). USCIS received my case on June 28th. Do you guys know by when should my check be cashed? I have G1145 included but i don't know if USCIS always responds to G1145. Thanks again.

@chabahil_nepali looks like you did not re_register TPS ( which for 12 month) last time , you should have maintain Tps to in order to get EAD. you might get denied.

@NJ NEPAL bro, as per the federal notice if one has reregistered at least once you will have maintained TPS status. Based on that one should be getting the EAD. Please see the excerpts below: "TPS for current beneficiaries under the designation for Nepal will continue, provided that they properly re-registered for TPS during at least one of the following registration periods for their country. If you have not re-registered during at least one of the following registration periods, you should file now and explain your reasons for filing late." "Additionally, USCIS is automatically extending through March 24, 2020, the validity periods of the following Forms I-94, Arrival and Departure Records, and Forms I-797, Notice of Action (Approval Notice), previously issued to eligible beneficiaries under the TPS designation for Nepal: Beginning date of validity: Dec. 25, 2016 June 24, 2018 June 25, 2018 June 24, 2019 "Any eligible beneficiary under the TPS designation for Nepal who either does not possess an EAD that is automatically extended, or wishes to apply for a new EAD may file Form I–765 with appropriate fee (or fee waiver request). If approved, USCIS will issue an EAD with a March 24, 2020 expiration date. Similarly, USCIS will issue an EAD with a March 24, 2020 expiration date for those with pending EAD applications that are ultimately approved." I have a TPS Approval Notice of Dec. 25, 2016-June 24, 2018. Do you still think i should get denied?

This is what Adhikaar Org send me. USCIS They received my application on 27th, I got a text saying my case was received in 1 week. I wrote a letter explaining why I didn't file for TPS last time. My case is still pending. Let's see what happens. Attachments Jun 27, 2019, 2:29 PM (11 days ago) to me Hello, Thank you for reaching out to us. According to the Federal Register Notice that came out on May 10, if you have TPS and EAD with an expiration date of either 6/24/2018 or 6/24/2019 it will be automatically extended through March 24, 2020. This means you do not need to do anything now. If you need to provide EAD to your employer you can show your EAD with the above expiration date along with a printout of Federal Register Notice. I have attached the notice below. If you need a physical copy of approval notice with an expiration date of March 24, 2020, you can still file for TPS with an explanation of why you did not re-register last year. USCIS only accepts "good cause" explanation. Hope this is helpful. If you have any questions please call our office.

@Donut bro, Had you reregistered during at least one of the re-registration period? The federal notice clearly says that if you had re-registered for at least one of the registration periods, you don't need to write a explanation letter. I had reregistered during the first reregistration period, which should be good enough for EAD application (as my TPS is valid) as per the FRN. I think the case workers haven't been properly notified on this as for other countries one had to write a explanation letter if you missed any of the reregistration periods barring Nepal and Honduras.

Yes, I have. I just followed the instruction that Adhikaar org told me to do. I'm not sure if we need a letter or not. I just send a letter just to be on the safe side.

Last time EAD took about 3.5 months for me, its only been 1.5 months since I applied this time so not expecting too much from USCIS.

@chabahil_nepali i applied EAD with wrong fee package returned . i resent, uscis received on June 10th and check was cashed out on June 14th. Within week they should be cashed out your check.. About EAD if notice says TPS holder (May 22, 2018–July 23, 2018) and (Oct. 26, 2016–Dec. 27, 2016), can apply EAD , they should approve. (Code A12 ) they are asking your TPS proof . if you have sent TPS (I821) approval notice and receipt notice . you should be good bro...

@NJ Nepal bro thanks. I have sent a EAD application along with the approval notice(I-797A) only with validity of Dec. 25, 2016-June 24, 2018. This should be good enough right. One just needs have re-registered at least once which i did even though i missed the last re-registration. There seem to have been some confusion around this. Also, do i need to sent receipt notice as I think already having a approval means one would not require a receipt notice. Am i correct?

Hello guys, Is advance parole document auto extended till March 2020 too? I have one which expired on June 2019. I did not use it last year. Can we still travel using the old parole doc with Federal Notice ? Have anyone spoke to adhikar org or USCIS about this. Federal notice says all TPS related document are auto extended. Will advance parole consider as TPS related document. I am not sure if anyone have come across this thought.

@chabahil_nepali just wanted to update you on my case status, my TPS got approved and I-979 says EAD card is being produced. Shipped my docs on June 24, got a text notification of my file received on June 27, TPS application approved July 12. Hope this helps and good luck.

@Donut bro thanks for the update. I am thinking mine will be returned again as i haven't heard back. The only difference is that i didn't sent a letter explaining why i didn't re-register last year. Also, confirmed from Adhikaar that i don't need to include a letter, I797A with end date of June 24 should work, which i included. By my bad luck USCIS case workers aren't knowledgeable enough about this look like. This is what i got from Adhikaar, and that is what i exactly filed with: "Hello, Thank you for reaching out to us. According to the federal notice that came out on May 10, if you have TPS either until June 24, 2018 or June 24, 2019, you are covered under automatic extension. This means that you do not need to file for TPS this year. However, if you have never applied for EAD through TPS you can file it now with a copy of TPS approval notice validity until June 24, 2018, along with other supporting documents. Hope this is helpful. Let us know if you have any other questions. "
