Smith Releases Draft STEM Legislation
Washington, D.C. – House Judiciary Committee Chairman Lamar Smith (R-Texas) today released a draft proposal to help the United States boost job creation, grow our economy, and remain globally competitive by increasing green cards for talented foreign graduates of American universities with advanced degrees in science, technology, engineering, and mathematics. This draft legislation eliminates the diversity visa lottery and reallocates up to 55,000 green cards a year to the top foreign graduates of U.S. universities with STEM doctorates. Any remaining green cards will then be made available to foreign graduates with master’s degrees in STEM fields. Chairman Smith intends to introduce his bill early next week.
Chairman Smith: “Many of the world’s top students come to the U.S. to obtain advanced degrees in science, technology, engineering, and math (STEM) subjects. We could boost economic growth and spur job creation by allowing American employers to more easily hire some of the best and brightest foreign graduates of U.S. universities. These students have the ability to start a company that creates jobs or come up with an invention that could jump-start a whole new industry.
“In a global economy, we cannot afford to educate these foreign graduates in the U.S. and then send them back home to work for our competitors. For America to be to the world’s economic leader, we must have access to the world’s best talent. The proposed legislation will generate jobs and economic growth by allowing U.S. businesses to retain outstanding foreign graduates of U.S. universities with advanced degrees in STEM fields. This will help us create jobs, increase our competitiveness, and spur our innovation.”

But I think EB2- NIW will still be there. Based on the pdfs I understood that STEM-green card will replace DV (if the bill is passed).

What abt Envrionmental Science? I know its a mutt between Physical and biological science. The draft is liitle vague as it claims.
I would still be happy for those with higher degrees if this bill passes. Its better then bringing some illiterates who showed fake documents when filing DV. They come here and whine and cry when it comes to work like an American.

Guys, don't get excited yet. You will still need a job and employer has to file for labor certification. If you have a job with PhD and employer is willing to file labor certification, you are qualifiy to get Green card under EB-2 easily. This bill doesn't make anything easier,, just ellimate DV (which is not bad).

Agreed, guys with Phd and Masters if employed almost always jump on the Eb2 bandwagon and get their green cards. I don't see anything new here.

Democrats want to preserve the lottery because many immigrants who come through it are from Africa and small Asian nations. Leaders of the black, Hispanic and Asian-American caucuses in the House released a letter this week opposing the bill.
To understand why DV Lottery is there, you have to learn the history of DV Lottery. The history starts at the foundation of this country. In its initial days, USA was the country who welcomed all the oppressed, persecuted, poor, rich, sick, or anything else with its open arms. That greetings was the symbol of liberty USA is/was known for. The statue of the liberty also has the message of "welcome to USA" and that welcome was meant for ANYONE, not just the rich, educated and successfuls. If you research the history of free immigration into USA since the begining you will see how the immigration rules has changed/narrowed from "welcome to all" to "not all are welcome". The DV program was created to leave that SPIRIT of ANYONE being coming to America. So killing the DV program is not just about democrates its about the tradition/history/value/spirit of this country. It will not go away easy.
The republican ploy has been to use the VISA catogery for corporations benefit for long time. This is not the first time they are proposing this. How about these repub rednecks just open up another 55K visa for higly skilled/educated people????
Republicans have two agendas, one is to serve their masters (the corporations) and two is to hate everyone who does not look like themselves.

The House voted Friday to cancel the annual diversity visa lottery and give those immigration visas to high-tech foreign-born who earn advanced degrees from American universities, as Republicans powered through their chamber the first major immigration bill since the election.
The 245-139 vote was a test of the GOP’s plan to tackle immigration piecemeal, and while the bill passed, the strong opposition from Democrats suggests that Republicans’ strategy will face difficult hurdles.
And while the chief selling point of the bill was to boost green cards given to science, technology, engineering and technology students, the bigger fight came over Republicans’ plans to cancel the diversity visa lottery, which the GOP argues is rife with fraud.
“We want to put to the head of the line the people who, every single one of them that comes, net creates jobs,” said Rep. Darrell Issa, California Republican, who managed the bill on the House floor.
Democrats, though, objected to making immigration a zero-sum equation, where any new visas would have to come at the expense of existing lines of immigration.
“I can’t support a bill that pits immigrant communities against each other,” said Rep. Zoe Lofgren, the ranking Democrat on the House immigration subcommittee.
She also said that it’s not a one-to-one exchange, and immigration would actually decrease under the GOP bill.
While all 55,000 diversity visas are used every year, she said statistics from the National Science Foundation show that there are only about 30,000 students a year who would even qualify.
After Hispanics were credited with helping boost President Obama in this year’s elections, both parties have been eager to find ways to tackle immigration.
Democrats say they want to pass a broad bill that legalizes most illegal immigrants and rewrites the legal immigration system, while House Speaker John A. Boehner has said his chamber will go piece-by-piece.
Both Republicans and Democrats agree more should be done to keep desirable would-be immigrants, such as those earning advanced degrees, here in the U.S. But they disagree over whether to do that as a stand-alone, or what should be coupled with it.
In the case of this week’s bill, it eliminates the diversity visa lottery — a long-time target of some Republicans, who say it invites fraud and could be a national security risk.
The lottery doles out immigration visas based on chance, with the goal of giving those in lesser-represented countries a chance to earn a spot. Every year, millions of would-be immigrants apply for the 55,000 slots.
House Judiciary Committee Chairman Lamar Smith, who wrote the legislation, said the visa lottery invites fraud.
In an effort to sweeten the bill for Democrats, he included a provision that would allow legal immigrants to let their family members, who are also seeking green cards, to wait in the U.S. with them, rather than have to wait in their home countries.

i guess if ur degree is master of science in management information system then it falls under stem. if the degree is master in management information system then it wont fall under stem.
i had read that it depends on how ur university has categorized the degree. your adviser is the best person to speak to.

nepali babu, look for the list of STEM majors on USCIS website, they have a pdf file containing the list.
Now, don't get too excited or depressed (biology people), because it going to have hard time passing through the Senate.

this bill will not pass senate. Democrats are not interested in this bill. They are interested in comprehensive immigraton reform which will provide path to greencard/citizenship to illegal immigrants in this country. This is a bargaining strategy by republicans when democrats introduces its version of immigration reform bill next year.
