Hi guys,
I have a masters in IT, and working currently. I didnt get selected in h1, and have opt till the december end 2015. I talked to my desi cons and they are willing to sponsor but said they never did it this way. I have to join school to get cpt and remain in status while gc is being processed. Is it possible to get gc like this as well, i read that it is not a must to have h1 to file for gc. Have any of you gone through this route and received gc ? Please share your experience and how long does it take for nepalese to get gc this way ?

Cyrus bro same story here but mine is not consultancy, my employer tried to file H1 two times and (my luck is good as yours )didn't made it through. They have already started my GC process and my OPT expires on December this year as well, if everything goes well labor will be filed this month and without any audit( finger crossed), they will file I140/485 late october and hoping to get ead early February and GC by next april/may, hope I only have to to go School for 1 semester. F1 to OPT is possible, just of my friend got GC a month ago from F1.

hi, I got my GC while in OPT and then OPT Extension. Only after applying did I find out that, if for some reason your 140 or 485 gets rejected, you will be out of status right away which is not the case with H1 because you just fall back to H1 status. I had some scares along the way because of audit during labor process. I guess if you apply right away and with everything working out in your favor you can get your labor approved and then file for 140/485 concurrently to get EADs before December. My suggestion would be to file for labor immediately and in the mean time also apply for CPT providing colleges. You do have to update your school of any changes to your address or employment because it is something they might look into later. So just send monthly emails to your ISO even if to say no changes in anything or until advised otherwise. If you can still apply for OPT Extension then you should be in the clear. Let me know if you have any more questions.

Would there be any risk on 485/140 application if i happen to join CPT colleges, since CPT from day 1 is heavily scrutinized by USCIS?

I did not work in CPT so I can not answer this question fully. But as far as I know, if you are doing everything correct and following all rules as required, it should not be a problem. They may question your transition to CPT colleges etc. so save all communications (such as with admission offices etc.) as proof. I will let other experienced ones chime in here.

Thanks a lot guys for your valuable inputs. I had opt extension and already have a college in mind to attend for cpt. Not knowledgeabke of all these labors and coded applications that i have to go through, but had heard about them. So the first step is file labor? How long does it take to get approved? For eg if ky employer files by june fiest week, would it get approved before dec? I think again here it depends. Second, once labor is approved when do u think ead is recieved? Sorry still at work and using mobile version of sajha and its difficult typing . Once 2016 april, i will consider filing h1 as well if former process takes long and i cross cpt timeline.

@Cyrus First stage is prevailing wage determination and your company needs to file that with DOL, that takes around 2 month next is Recruitment process that's another 2 month, then the actual labor certification and as of today that is taking around 165 days, then you can file I140/485 concurrently and expect EAD after around 80 days or so, actual green card will be around 5 month of filing I140/485 concurrently.so you will get your in EAD 12 month if you start today. I am stil on the recruitment process which started on first week of march and I am still stuck in this phase, as per my calculation if everything goes well my EAD will arrive in January. Since my EAD expires late December i have to join CPT school for couple of months. Moral of the story is ask your employer to start as soon as possible just to avoid spending lot of money in CPT colleges. P.S do you have any CPT college in your mind?

Thanks again, a friend of mine goes to american college of commerce and technology, day 1 dekhi dinchha arey cpt. But i doubt if mero desi cons le etti chado gardela, even though i have been with them for over a year. Khoi yaar koi kaali lai fasaye thik jasto ni lagchha at times rather then stress with school bs, db masters.. but second route is riskier too

My employer aka desi cons is willing to sponsor gc from opt. Expenses haru maile behurnu parne hunccha. Job advertisement will require fees, they have in house lawyer but still desi le paisa alik thataula because of my situation. Any idea on expenses incurred for gc processing. Thanks

Not sure bro maile ta afai gareko haina tara asti kura garda Lawyer le add haru rakhna expensive huncha bhandai thiyo.....just a rough total estimate would be around 8K -10K (better than going to CPT colleges).
