Hi Guys, Need your advise or expertise. I have pending asylum ( almost 16 months now). Yet to get an interview. I applied TPS and on the same. Anyone knows if my asylum case stops till I am in TPS. Any help would be appreciated.

@Facebook is right. Since I work in an immigration courtroom, I have seen numerous cases like your situation. TPS and Asylum are different things, so getting TPS will not hamper your Asylum case.

@jholejindagani dude I have the same question. Is your TPS approved? I am an asylum applicant as well and my tps is pending as of now. I filed TPS around last week of June.

Filing for both affect the timing of interview or timing for decision if they overlap. When did u apply for Asylum and TPS? my timelime is- asylum filing Dec 2013, interview scheduled Jan 13,2016 (cancelled) no new date, TPS filing Dec 10 2015 , biometric (Jan 08, 2016), TPS status- finger print fee received

Sachin: I was also so tempted to file TPS, however, my lawyer always said not to file for TPS while asylum case is pending. His logic was, you cannot get two immigration benefits at a given time. So according to him, if I had filed TPS, my pending asylum case will go in administrative hold, meaning, the scheduled interview date will be canceled and new date for interview will be scheduled, which in turn, will be pending. My master hearing happened in August 2015 and my Individual hearing is scheduled for July 2016. Thank god, he always and STRONGLY, said that filing TPS will kill my asylum case for uncertain time. And I followed his decision, which, I never liked to do. Now I feel, I did the right thing listening to my lawyer. Good luck for you man!

@Sachin, Sorry to hear that bro. Let me tell you what happened with me. Asylum filed: Jan 7, 2014 TPS filed: June 27, 2015 TPS case status: Fingerprint fee received Asylum interview; Jan 20, 2016 Are you sure your interview was cancelled because you filed TPS? Did they tell you that? That could have been cancelled due to other reasons. On Friday Jan 8, I went to inquire about my status, and they told me that I have an interview on Jan 20. But, I never got any mail. I felt lucky to have inquired about my status that day. I submitted all my supporting documents on Jan 11 and I had an interview on Jan 20. I will have my decision on Feb 3. Let's see what they decide. I don't think your asylum interview was re-scheduled because you had filed TPS. May be consider talking to an attorney bro. I had talked to few attorneys, and all of them said it was ok for me to file TPS while I had a pending asylum status. Some attorneys strongly advise you to file TPS, some say it doesn't really matter. I haven't heard any attorneys say NOT to file TPS unless I read the above comment from hari_nepali. Good luck bro!
