Hi guys ,

I have a situation. I was working in OPT and then switched working using TPS. As you know in OPT we pay less tax and with TPS citizen like. I tried to use tax software and it showed I owe few hundred dollars to the state govt. Any workaround this? I cannot include immigration status of TPS or OPT in tax software. Just confused how to fix this issue. Anybody experienced similar case? Thanks in advance.

I think the short answer is no. You have to pay back what you owe. I have to pay several hundred bucks too.

Saptarangi bro, on a separate note, once you switched working on OPT to working on TPS EAD, did you have to notify your school about the update?

if we have TPS EAD, do we have to specify that we are working under TPS EAD or OPT?

You did not mentioned which state you are talking and each state has it's own rules.
Bro: where are you, this gentleman needs your tax saving tips.

I didnt notify school. I continued working after updating my employer with TPS EAD. Tax deductions are similar to what US citizens pay.Thus you pay higher tax amount.

saptarangi bro: There's no tax benefit (at least income tax) whether you work on OPT or other EADs. The only benefit when you work on OPT (as a f1, j1 visa) is that you don't have to pay your FICA and medicare taxes. But if you are a resident of that State, it is what it is. You can try filing NR for state filing as well but you will be taxed on all income you earned in that state. Just pay the damn taxes.

Remember IRS has nothing to do with Immigration.

So, I am working in TPS and was in OPT before. I am not attending school. What is my status? I have heard in order to be in F1, one needs to attend school. Please help.
