Hi guys, I have 2 questions regarding TPS EAD for F2 dependent. I am under F2 status since last year. I have filed TPS without EAD and the result is pendiing Can I apply TPS EAD now? I am not working now but found a company which is willing to sponsor me a job and H1B. Am I eligible for obtaining H1B through TPS EAD? What will be the procedure. Any suggestions will be welcomed.

Hi, You could have applied for TPS with EAD just paying $ 380 more. You did not realise that TPS with EAD was the best fit. You can work while remaining in F2. Now since your TPS is still pending, I am not sure if you can apply for EAD, but you can try. Getting EAD will take around 90 days, if lucky , you might get EAD within 2 weeks after biometric test. However, using EAD card without TPS approved is not advisable. So, just apply and lets see. Nothing wrong in applying right.

Better option if the company is willing you can even apply for GC. Provided TPS is still there and you are qualified, which it looks like since you are talking about h1.

Yes, couple of my friends have started the process since H1B is a shitshow with entire Hyderabad applying. If your company or consultancy agrees to file you can. The only but in this case may be till when the TPS will remain valid and your company's financials. Will take around 2 years.

GC is better option that H1B. H1B locked you with the employer and if direct hire and lay-off happen, you are out of status. So, choice is yours.
|
