I am in the United States right now. I came here with F1, and now I am out-of-status. I had to quit University 1 and 1/2 years back. Are there any ideas among any of us whether I can study in any state of US or not? Does anyone know someone who went to school again as an out-of-status student? I would appreciate any comments and suggestions that would be helpful.

As far as i know, once a person is out-of-status(F-1), it is impossible for him/her to join the university again. In your case, you might wanna go back to Nepal and apply for student visa one more time but as you've already broken the laws of the United States Goverment, your chance of getting approval is very very low...You might wanna talk to a lawyer about this before taking any further steps!!

Actually, Nepaligurl is partially right on what she said. Basically, first of all talk with a lawer who can get you the best advice, they usually know the way around it but might costs some dollars bills there. Once you are out of status. thats basically it unless lawyers do anything about it or BUSH proposes an amnesty plan which was done long time ago... but if you GO BACK TO NEPAL OR LEAVE US YOU WON'T BE AB LE TO BACK AT ALL.... I KNOW THIS MUCH FOR SURE...... good luck

If you really want to study, I would suggest you to go to anyother country and study. If not, then, better stay here as much as you want, and as much as you can, and then go back to Nepal with some pretty good money. Who knows, Bush might come up with the new visa, or temporary status for illegal workers, or out-of-status people.......

I was once out of status for about a year but this Indian Lawyer was so good he put me back in school. He'll charge u a lot but 100% job done.

1. I had heard that in TX it is possible to get admitted in the colleges even after you are out of status. This might not be 100% true but you need to do more research on that. May be texan fellows can help you on that part if this is true.

2. As long as you can satisfy the requirements of the school and school accepts u as an F1 student, immigration does not do anything on that. As long as school is on your favour and post the status as satisfactory, immigration does not come to you and your F1 status is reinstated. You will be penalize for the reinstate of your F1. (So far i know, this works only in few states like TX, CA, MN, MD and few more).

3. Like Ma Nepali wrote, you might need to consult immigration lawyesr(yes indian immigration lawyers can understand your situation easily). This indian's idea might not work in all states so that you might need to move to other state like TX if u wanna reinstate your F1.

4. So far i know, if you were out of status more than 1 year, u will not get re-entry to usa for 10 years. if it was less than 1 year, u can get re-entry only after 3 years. if this was less than 1 months or so i think u can get entry after 1 year. I might not be 100% correct but the law is like that.

5. There is another way to get admitted in college if u do not care about the status but wanna finish your school. This is little tricky and can be risky. I am not goign to write here, like kg4mvp wrote above, you can email him/her. I belive s/he has the pretty much same idea that i have on my mind.

6. If nothing worksout, like paakhey wrote above, stay as much as you want without any violation, you will be alrite. Once in a while there comes opportunities for illegals, if u are working in any place and filing the taxes promptly. belive me Bush will bring some kind of program like guest worker or so which can get in 3 years legal work permit and can be extended to 6 years. I think mexicans are already benefited by that new rule.

7. Do not worry, you are not the only one suffered. There are tons of guys who have quit school because of various reason.

I don't think you will get US visa again. I know a person who was out of status but he never realised that. He went to Nepal and applied for visa but didn't get it. The only reason "HE WAS OUT OF STATUS" that's what embassy people told him. So, stay in US as long as you want.

Shiva shakit , why don't you get married with american girl if you are single and you will get relief from this stress. You can live legally, go to school legally and work legally after that.
