there is no such thing as asylum visa. There is only asylum status. You can apply for asylum within one year from the date you are here in US. You have to prove that you are in danger of torture or death or imprisonment due to faith in you own country. Thats what I know. If you want to know more, google it or seek legal help. There are some places where free legal help is available.

Yeah, and once you apply for asylum, you buy a case of 24 bottles of Budweiser, glup em down, and come to sajha, and preach us about brain-drain, why we should go back to Nepal?, and preach us about Democracy, love for the country, and even engage yourself on a discussions like how to develope Nepal and stuffs. :)

Asylum is a discretionary immigration relief granted to those who can prove that they have a "credible" fear of persecution if they are returned to their home country. This fear has to be on the basis of five different grounds: race, religion, nationality, membership in a ptclr social group and political opinion. The fact that past persecution has occurred on these grounds leads to a presumption that the same could happen again, if country conditions have not changed since the applicant left the home country. Someone mentioned the one year thingie. Yes, that is a catch. YOU have to apply for it within a year of entering the US, unless you can show that exceptional circumstances prevented you from doing so. Many who cross the one year deadline are granted, if at all, only withholding of removal, which is similar to asylum but does not put you on the path of permanent residence or citizenship. More details available at http://uscis.gov/graphics/services/asylum/index.htm Asylum can be applied for ONLY if you are already in the US somehow. Hope this helps........

In addition to the information posted by MazeMyan, the person applying for asylum i.e. you, have to able to prove that you personally have faced threat/injuries as a result of your affiliation with one of the five criteria listed above. It is NOT enough to show that a family member or colleague faced harrassment etc if it did not personally impact you. The additional hurdel is that due to a large number of fake applications, USCIS is very particular about the statament of facts that you present and in recent months has begun a system of checking the facts as you claim with what the U.S embassy in the home country believes/knows to be true..meaning, you can't say whatever the heck you want. The fallout of an unsuccessful application can be very severe; If your asylum petition is rejected, you have the right to appeal the decision by USCIS to the BIA (Board of Immigration Appeal) but if the BIA also rejects your petition, the only option in deportation- either the U.S Govt will deport you which renders you ineligible to re-enter the U.S for 10 years from the date of deportation. The second alternative is to opt for a "voluntary departure" which means you agree to leave on your own terms. Immigration auhtorities will give you a departure date by which time you HAVE to leave the country, failure to do so renders you inadmissible for another 10 years. If you leave on your own within the time given, you are eligible to apply for re-entry after 5 years from the date of deportation. I know lots of people think they can fool the system and not show up for deportation hearings, but, failure to appear at removal hearings is an offense also punishible by bar of 10 years from re-entry. All this means is that you need to be careful before applying for Political Asylum..I know lots of people think it's easier to get it but this is a big misconception.

There are high chances of getting one, if you apply for it before its 6 mths you've entered the U.S, i.e. if you've entered the U.S in July, apply for it before January. You have to have strong reasons, like maoist threats etc in Nepal. My relatives too have applied for it, I'll try to find out more.

The following message appears on several threads on Political Asylum. Please people, be careful. This is a serious issue with the Nepali community and you need to be aware! This may improper on my part and what I have to say below is not an attack on your desire to help the Nepali community but as a Nepali and someone who is aware that there are many who are working overtime to make fools of the Nepali community with all manner of promises, I have to say the following: For those of you that frequent this forum and may be considering applying for asylum based on the circumstances back home, please be very careful about the attorney's you choose. As a current law student and someone who has worked in the Nepali community with lots of Nepalese who have been taken to the cleaners by unscrupulous attorney's..please make sure that you know the attorney's history and track record before you hire them to represent you. Political Asylum is NOT an easy application to make. There a lot of requirements that have to be fulfilled. First of all, applications have to be made within a year of entering the United States and the applicant has to be able to show a fear of persecution or a well founded fear of persuction to them (meaning, you cannot show that becuase you or your cousin is a mamber of the Congress, Communist or even KG's cabinet for that matter, your life is at risk. You have to show that your own Religious, Political, Social Group or National Origin put you at a risk in Nepal) The consequences of a failed application are sever - deportation is every possibility and yes, you can appeal the decision of the Immigration Judge but the appeal is a very lenthy and expensive process. I am not telling you to NOT apply, all I am saying is BE CAREFUL!...there are a lot of attorney's who have no concerns about charging am nuch as $3000 for an application and you should not become a victim.
