My suggestion would be to file for Premium Processing if you filed in EB2 category. If you filed EB3, it might be just a waste of money depending on your priority date. I filed I140 back in November and I have not yet received any updates after receiving the Receipt.

Bhasmasur Sorry, I am new to these kind of stuffs. However, I am going to be in your situation pretty soon. I am wondering, can't we do Premium processing, while filing I-140 ? I mean, do we need to wait until we receive the receipt ? - NF

hey guys, my wife is planning on filing EB3 "other workers" . she is babysitting and the family(boss) wants to sponsor her to get her Green card. What is the first step? i research some in internet and found that the employer needs to file ETA 750 Part A and Part B and send it to department of labor, DOL will try to find to fill the position with US worker and gives advertisement as well. if they don't find any, the application gets approved then she can file the I-140 and then I-485 to adjust the status. This is what i know so far. But i am sure its not that easy as said. if there is anything missing or any important things to know , please let me know

Do you really need a lawyer in this process?

Hi Guys, I know this question always buggs you, specially when you are in process of GC 'How reliable my company is ?' One way to analyze your company is to know how many employee were certified / denied with Foreign Labor Certificate, Last year. The link below will take you to Department of Labor official web site. http://www.flcdatacenter.com/ Just download Disclosure Data (2006). If you are familiar with MS Access OR EXCEL, just play with these data. You will know - How many application were filed - How many applicants were certified or denied ? When? - How many Nepalese applicant were there ? etc. Please, Be noticed - This is only for Labor certificate. Hope this will help - NF

Bhasmasur, It took about 2 weeks to get the receipt. Since your application is EB2, I would highly recommend that you upgrade the I140 to Premium Processing even if you have to pay additional $1,000 out of pocket. Once you get the I140, then you will be able to file for I485, I765, G325 etc.

If you date is current, you can file I-140 and I-485 concurrently, there is no problem with that.

about the green card for baby sitter, you have to file it under EB3(2) other workers catagory, of which the visa has been Unavailable - meaning you can file your labor, and once its approved you can file I-140. But until your date is current you cannot file I-485(which is the green card).
