Hey Guys!

I came to hear from the IRS People that international students(Non resident Alian) in F1 Visa are not allowed to file their tax online. Information about filing the tax is appreciated in this thread. I filed my tax on 2007 for the year 2006 online. Now IRS has asked me to ammend the tax return using 1040X and has asked me again to fill 1040 NR-EZ and 8843 again( Usually Online tax return fills 1040 EZ for you)

So Be careful, filing online is similar to working illegal .

And one more thing,

All the students here in USA, need to file Form 8843 whether they had earn or not in 2007.

Please try to make your stay legal.

How they figured out?? That is true all international students need to file 1040NR. If you are in Iowa, they do not give you w-but different form which is given to foreigner who earned income in USA. So did you get different than w-2 form to show your income in 2007?

If you have to file 1040 NR, you will not be able to get standard deduction but you can itemize mandatory educational expenses, books and related expenses like lab fees, mandatory school fees (not tuition and health insurance), may able to get your tax liability down and get some refund.

So, please keep records of books and supplies & all mandatory fees. In case of audit, you can submit.

Is this true for eveyone or were u just a statistical fluke (one in less than 5% that gets audited)?

That's what happened to me last year. Got a letter from the IRS asking why I filed 1040 EZ instead of 1040 NR-EZ.  They asked for details on how I paid for school, asked me for my I-20 and other details. I had to file a 1040X (amendment form). I guess its luck when it comes to you getting audited. I was unlucky but I know a lot of people who file online and haven't got in any trouble. The only drawback is that the interest rate that the IRX charges for back taxes on such issues is usually higher than what most credit card companies would charge.  So might find yourself paying the IRS some boku bucks!!!

I think once you are here for over 5 yrs, you can apply online( i.e; as a citizen would).

what about the students working on paychecks (though illegal)? They get W2s....how do they get returns?

Student who work in pay chek should also file 1040 NR-EZ and you will get your medicare + social security tax return. if you dont file 1040 NR-EZ, you will have problem while applying for Green card but not for H1.

So please dont work illegally. and if you work work on cash.

I got W2 from my bank for the income I made through interest they paid me.

Is it ok to make income through bank interest by someone who is in F1 status?

If you have received 1040 S instead of W-2 , you must file 1040 NR otherwise you will be getting audited and has to amend your previous tax filing.

Who ever files 1040 NR EZ will not be allowed to deduct standard deduction which leads to higher tax rate and less refund.  On line 11 you are allowed for itemized deductions. All mandatory school expenses not insurance and tuition, lab fees, books and exercise copies and related to your school are allowable deductions. Advised to keep them for proof in case you’re audited. In past I had met couple people who had filed 1040 NR; they always itemized and were able to get little money back.

Actually the form I received from Bank is 1099-INT, not W2 as I incorrectly said in my previous post.

I opened the bank account as US resident but I am still in F1 ( I have been here on Dec 05). Will it cause any trouble?

My campus does tax filing for free (for Int. students). So i was wondering if they would question me how I got 1099-INT.

Or it doesn't matter at all.

Actually i was about to file my 07 Tax online so i guess i should learn more about it before i take actual step. so guys pls suggest me, just like other i am Int. student but i been working on my SSN for almost year but never think of consequences but now i am kind a afraid. How does it work  if Int. student who is not allowed to work filed a tax  to get  tax return. isn't that wrong. Guys help me out on this.......

dont worry unforgiventale...

i havent even filed my taxes yet...  i thought it was only for us citizens.. so i didnt do anything for years.

Sapanasansar did not mentioned if he had received 1042 S or paper that should  given to alien who had earned. In that case if you file as a us citizens or residents, IRS will nab you.

Your interest income has to report on tax filing. Do not be happy with not filing taxes. If you want to apply for green card you may need it in some point. It is better to be be in safe side filing taxes, you may able to get little refund.

Interest should be included in your filing as income; it does not bar you filing tax. So far my little knowledge about 1040 NR, you will not be able to get standard deduction and sometimes school may not let you know  (if helping to file taxes to foreign students) that you can itemize your mandatory expenses as NayaSadak mentioned, which will lower down your tax liability and may be able to get some refund.

Please, do some research on itemized deduction you are allowed.
