What is the current procedure for foreign trained nurse to apply for green card? Do they have to go through Labor Certification Process? This web site (http://usavisanow.com/nursegreencardinfo.html ) says  they don't need to go through Labor Certification process. Is this correct in present context?

If you're in Nepal, then forget about applying because retro-wait is so long... almost 5 years that literally employers are not willing to go ahead with sponsorship at all.

However; if you're US graduate, then atleast hospital will be able to get you work permit, travel doc etc but then GC is still a waiting game. Hoping this helps you.

Since Nurse GC is does not go through normal H1-B process, and is not charged against any kind of VISA, its simply a waiting-Game. From above link, see table, and look at the date 2A (15MAR03); and currently we're in 2008, 5 year lead.

Again, if you're in US, ask your employer to go through H1-B, you will get your GC sooner, but then if you're marrried your spouse won't get to do anything until I-485 process. Where as going directly to GC with I-140 will give Work-permit and everything to your spouse too.

Either you are in USA or Nepal, forget about working as RN in USA in near future.
There is long retrogression of 3-4 years to get work permit or GC. Better think about
other option.

lamak_98 , the link of visa bulletin you have given, the date for the column 2A applies to family base visa category. Its not nursing visa. I don't think you are aware of that. As far I know, nursing visa for RN which used to called schedule A visa, is not there anymore. So only option right now is have a bachelor degree and go for H1b. correct me if i am wrong.

Two of friends just got RN job and moved to LA. They were RNs from nepal.

Why dont you ask with an immigration lawyer, they dont charge you anything just to answer that much. as far as i know, you have to go through all procedure, labor/ I140/ I 485- I strongly suggest you to check with an  immigration lawyer, they will tell you without any charge, any of them out there. and if you are in nepal thinking to get GC from there....as a nurse,  forget it, its just impossible.

I don't know the whole process.The only thing I know is  they were here on student visa. They did the evaluation from CGFNS, took the NCLEX test and got their license.

Palu, do you know  how long that whole process took and one more thing, did they complete RN for US or they used their license from Nepal and re-evaluated that from cgfns.

I would say the whole process was about a year. As I said ealier they took the NCLEX test to get a RN license for US. They had to evaluate all their trascripts and license from CGFNS in order to get scheduled for NCLEX test.

as far i understand, you have to evaluate all the degrees and license from cgfns. then  you have to give toefl or ielts but that depends. after that you will be allowed to take nclex exam. Once you clear ur nclex exam, you will get nursing license. but some states will make u take cfgns test too.

about  how to apply work permit, I don't know. only plau seems to know something about this.So palu we need your help again.

If you are Foreign educated:

1a. Apply for CGFNS Certificate Exam from CGFNS (www.cgfns.org)

1b. You can bypass 1a step if you have a Bachelor's degree, as many State Boards of Nursing accept direct application and do their own transcript evaluation. In that case apply directly to your desired board of nursing for NCLEX exam (remember, you can also take these tests from India or Hong Kong too).

Contact address of all 50 State Board of Nursing is available at National Council of State Board of Nursing or NCSBN: www.ncsbn.org

1c. Prepare for the NCLEX and take the test once the state board of nursing confirms eligibility.

2. Apply for VisaScreen Certificate from CGFNS. If you have already taken the Certificate Exam from CGFNS, the same documents will be retained regarding your transcript and nursing license verification.

3. Send additional documents to CGFNS: TOEFL ibt or IELTS score (look at the www.cgfns.org website for requirement) and NCLEX passed result from State Board of Nursing where you applied.

4a. If you don't have a 4year bachelors in nursing, then Wait, Wait, and Wait .........................................

until the visa bulletin http://www.travel.state.gov/visa/frvi/bulletin/bulletin_1360.html shows the the employment based category is current for either 'Schedule A' or 'Employment Based Category 3'

If you are US educated or have 4-year bachelors in nursing, then complete steps 1b through 3. In the same time, try for H1B.

When doing transcript evaluation, we've to send the 'Academic Transcript Release Form' to the issuing boards (such as HSEB for +2, or TU/CTEVT for nursing) in Nepal. Are these issuing boards aware of this thing? And do they have to send the original transcripts/degree certificates directly to the evaulating agencies in the US(such as CGFNS and WES)? I mean to ask that will they've another copy of our degree certificate with them or we've to send our copy of degree certificate to them so that they'll send it to the evaluating agencies? Please share the specific info if anyone has gone through this!

harris, didn't u read palu's comment.her friend with RN from nepal recently got job. and one more thing every states doesn't require cgfns Certificate Exam. most of states now accepts CES from cgfns which is only evaulating degrees and license from nepal.

Xbox, I am not sure on what condition her friend got work permit. If she had applied before the retrogression happened to nurses (which happened only last year as compared to other EB3).

Many State Board of Nursing accepting CES from CGFNS is a good sign (though CA and few other states make ISc Nursing from Nepal deficient in Psychology courses and require about 3 credit hours remedial classes). Colorado and New Mexico accept both TU and CTEVT graduates from Nepal without any remedial classes.
