Hi All,
This afternoon I checked my status for H1B, then I saw my case status changed from "Case Received and Pending" to "Request for Additional Evidence Sent". What other information do you guys think I might need to send, and if anybody has received something like this, please share.

if u had applied before graduation, may be they require your degree or transcript.However, it could also be due to employer's information required.wait for the notice..good luck.

I would like to ask you guys if there is any such thing as applying for H1B before you graduate. I have a similar problem, I have already used my OPT for master's, now I am going to finish my MBA but this time I will not be getting any OPT and on top of that I will not graduate until July of 2009. But H1B application due date is in April which is few months ahead, so I do not know if there are any other options left other than PhD or CPT. Please any suggestion.

it happened to me for the permanent residence, they wanted a letter for my employer that i am still emplyed and still getting paid the salary i had submitted. since it had been lottle over a year, they just wanted to make sure i am still employed. i believe they will give you some time to respond.

They also sent me the RoE letter on 10th June. They requested the proof of my masters (which I didn't submit earlier) and the "detailed" job description from the employer. They gave me 30 days to submit the document (starting June 10th). I received the letter from my lawyer on June 17th, gathered all the documents needed by 20th, lawyer submitted them on 20th, on 27th, the USCIS website updated my processing has been resumed and the decision will be made within 60 days unless they need more documents from me.

sshanti When I had applied for my H1B in 2006, I had got the same RFE. The scenario was my opt was ending on June 31st. I had no work but my H1B had been filed. I was vouching on pushing through 2months of grace period and start working odd jobs, that would still make 2 months of my stay in USA out of status. H1b generally starts from october. After that I had to fetch 1-20 froma small college and send that as RFE to the USCIS stating that I will be taking a semester of course from the collage so as to remain in status. And guess what, it worked. My h1B was approved and i didn't even take much classes and from november I started working a real job. does it help AS RFE I had to get I-20 and send it to USCIS...bottom line...I dunno how your case is though Biks

well spreadlove, i dont think that is what he got RFE about.In 2008, the rule has changed that if your h1b case is pending , u do not require to join college during the cap gap.One will be able to work during the cap gap until the h1b starting date (if approved) or until the date of rejection acc to the new rule.
sshanti bro, there are various reasons for RFE...u need to wait for the notice and if they are asking any documents..u will have 30 days to send that.so dont worry much, most of the people get RFE issues fix.should not be that bad.good luck.

I had a similar situation but it happened when I had to transfer. It is not necessary only on your part but also in pary of the employer, the company lawyer will write you back. In my case they want the detailed Job description with my role on it which I sent later and worked good.
