HI,

Can anyone please provide me what documents are required for obtaining H4 Dependent Visa for my wife and daughter. I got H1B this year effective from 10/1/2008. I talked to lawyer but he/she said that they need 100$ just to talk. So, I am looking for a hep through sajha forum to provide me information if you have done this and knew about the process. I would be thankful to you.

I have heard that the chances of rejection for the dependents are high this years. So, I donot want to take risk this year. I can wait for another 2-3 months but I would like to be sure before I apply this year. Please share your experience ..Thanks

Neerman jee.. you will need following documents for your family:

1.I-94 forms of both of them

2.Copies of passports

3.Daughter's birth certificate ( I presume she is not married)

4.Your marriage certificate

5.Copy of your H-1 approval from

You can fill up the ' request for change-of-status ' form yourself after downloading it and save around $500 in attorney fee.

You do not need to file an application here in the US. Instead, your spouse needs to apply for a visa at the US Embassy in Kathmandu for the same period of H-1B authorization.

The documents required are:
  1. A copy of your H-1B approval Notice
  2. Latest Three Pay stubs to evidence your bona fide employment
  3. 2007 Tax Return
  4. Documents evidencing your non immigrant status in the US in the past (e.g. I-120 etc)
  5. Marriage Certificate
  6. Birth Certificate
  7. A letter from your current employer verifying your employment with start dates
  8. Financial Documents (Bank Statements)
  9. Passports
  10. A copy of your passport, I-94 and Visa
