hi my wife is a beautician expert and she is curently working in a beautician parlour. she is in F-1 status. her employer is ready to file her green card but the question is how can we do that. is it possible for filing EB 3 or EB 4. also can we file H1-B from this employer because she would be graduating soon? is there any way for getting green card? and also how long would that might take?

any help from immigation expert would be grateful. looking for your response.

It is possible to get green card from F1 status through work...but its rare...if she wanna file for green card now...she should be first legally eligible to work..otherwise first she has to change it to H1-B then follow other process...

she does have EAD card that is obtained from OPT after completing her degree and valid for a year. how does the process goes after this?

I had talked with a nepali lawyer a long time back. he says find a job and apply H1b and then green card. but it is so difficult to find a job these days especially without a computer background and looking for a faster way for green card if it was possible. i dont know anyone who has filed GC through skilled workers.

Getting EAD through OPT clearly indicates that he/she need to work in her field of study..If her degree is related to beautician then it's fine...otherwise she will be in trouble..these USCIS people are making life complicated for us..yes you can file GC while in OPT but need to maintain her status till the GC processing time and the Process of applying GC from OPT is freaking tough , i guess..and please contact immigration lawyer regarding this..there are lots of Loopholes in the system and lawyers are best at exploiting the system.

Sajha man,

Of course, pyaradeshbasiharu is advised to you. The USCIS is very tough  day by day. Therefore, you have to consult the immigration lawyer. Because, you have to maintain the status after OPT-legally till the date of adjustment of status. Otherwise, it will be trouble. However, OPT is and your present work must be matched even you filed the H1B and GC. Otherwise, such experience may not count.
