 Dear everyone,

Hajur haru sanga feri yeuta salla maagu bhanera lekhdai chhu. My wife has just got approval for f1 status effective from august 25th. Before that she was on H-4. So, technically, she is on h-4 till august 25th when her f-1 status kicks in as a grad. student. But her professor wants her to work from 2nd week of august and he will pay for that. I am not sure if she can take payment until august 25th because technically she will be in h-4 till that date. International office says you can work 1 month ahead of scheduled date but that applies to students coming from overseas, but not sure if that applies to people who change status here. I am in little confusion. Do you think its legal to work and get paid before august 25th? I know international students can start working 1 month ahead of scheduled time but not sure for someone who has changed status from h-4 to f-1? Tapai haruko uttar ko pratikshya ma chhu.

Thanx in advance!

I can't fathom why people start shitting bricks when it comes to immigration rules. During college, all my friends, seniors and I worked using our SSN, sometimes with a valid EAD card, sometimes, without it. I clearly remember how people were talking nonsense like 'your gc, H-1 visa etc will be held and rejected' etc. It turns out, that wasn't correct. When your wife file for her taxes, the USCIS or IRS won't be verifying whether, how or when she started working. All the IRS will be caring about is if she paid her taxes or not.

To cut this all short, I'd not sweat over it. If you're gonna go into minute details like "only people coming in from oversees"...etc. you might as well start scrutinizing yourself. This will ultimately lead to you screwing and jeopardizing your peaceful soul.

Good luck.

The best is to talk to the professor about being not authorized to work but if he insists, work from the date he wanted but with no paperwork and get the payment only after Aug 25. For the hours worked before Aug 25, talk to prof to raise the per hour rate for first couple of weeks after aug 25 to match those hours and thereafter use the normal rate. People worked on SSN during F1 since they have no choice. As long as you have choice, it's better to be in safe.
