Hi Guys,

Have anybody's spouse in Nepal got H4 visa lately ? I have some questions regarding this like:

1. US emabassy has increased application fee from $100 to $131. But does applicant have to pay visa fee as well like in F1 visa i.e. $ 200. I have heard that in India they don't have to pay even F1 visa fee, only application fee of $ 100 is applicable for them for F1 or H1, H4.

2. Does applicant have to show his or her spouse's bank balance in Nepal as well ? I am sending my bank balance statement from US as I am in H1.

3. Does she need to fill up application form online only ? I am asking this because she is not computer friendly. And I have heard that Nabil bank or any other shop charges too much to fill up the form.   Now NABIL also has started to make its own group for visa . I have heard photo also has to be taken from NAbil's recommended photoshop.  Anyway...

One of my friends got her spouse in the US last Dec. He told me the whole visa process went very smoothly.

1. When my friend was applying, the application fee was $100 each, so it's $200 for him and spouse. When in H1, you don't have to pay visa fee unlike for F1 applicants.

2. If you're sponsoring your spouse, you've to show the bank balance, not your spouse's. Your bank balance from US should be good enough.

3. Yes, your spouse have to fill the application form online and print it out. If she isn't computer-friendly, then I'd suggest you to do it and send her along with your bank balance. She'll just sign the form.

Note: Don't forget to send the petition copy of your's and your spouse.

rmxyz,

There are a number of photocopy/computer shops right in front of the American Embassy.

They take Rs. 100 to fill up and print the online forms.

Ask your spouse to go to one of these places.

These guys do more than 100 visa application every day.

You can trust them, they know what they are doing.

Dear Delicate and Bandhu

Thanks for your suggestions.

But I have one confusion from this  written by Delicate : " Don't forget to send the petition copy of your's and your spouse."

I have my I-797 approval letter attached with I-94 and I'm sending those with other related docs. But I don't have any petition copy of my spouse..

Please suggest..

Again, all you need is your I-797 petition. That's how I got H-4 visa for my spouse a couple of months ago.

To the best of my knowledge, you would have submitted a I-797 petition for your spouse only if she was here in US when you applied for your H1B.

Other documents that you might need are marraige certificate, verification of employment and pay stubs from last couple of months.

My thinking is also same as of Bandhu in this regard.   Since she is not in US so I didn't have to file petition for her in US.

Originally, my friend wasn't planning to go to Nepal. So in that case, his company suggested him to apply the petition for his spouse. Also, please go to the following website that suggests to get the petition for the dependents:

http://nepal.usembassy.gov/temp_work_visa.html

It's best if you check with your company and make sure if it's needed or not. Please don't rely fully on my words as I am not an expert. I am just telling you what I know.

I had visited this site earlier and I was also confused about this sentence :

"Approval Notice of the spouse - Form I-797 issued by the USCIS.."

But later I came to know that Form I-797 issued by the USCIS is for me.  Not for my spouse. How can she get I-797 approval here when she is not in US.  I consulted in Muthy Forum as well and got same reply.....

I dont think you get I-797 for your spouse. Receipt of Notice is for within US only when a person is in US and has applied to USCIS.

Hey Guys
Though most of the informaiton listed here earlier are very much relevant but still I would like to get some information if any of you can provide.
I applying H1-B this year and would like to know the procedures to apply H4 visa for my wife.
I have talk to my lawyer and was told they can't file H4 application since my wife is not here.
Lawyer did not provide me the accurate information. Pls advice me the following:

(1) Once I get my H1-B confirmation, is it possible for my wife to apply H4 immediately or she need to wait until Oct. 1st since H1-B will be effective from that day onward. This is my main concern.
(2) On US Embassy's website, it says, "Evidence of Financial Resources". Do you think only the paycheck stuff is good enough?

Appreciate your advice.

That I-797 is for your H1B approval. You must have a copy (check if you need to send the original) of this notice with the H4 visa application for your spouse. This is the first piece of document that the consular needs to see.

How about the spouse who is accompanying the H1B applicant here in the US as F-2 visa holder?I mean what is the procedure to be followed for changing status from F2 to H4?Is it necessary to apply H4 for the spouse  and kids along with H1B ?Or it can be done later once the issue number is provided ?Any information regarding this is highly appreciated.

You have to H4 for your wife together when you apply for H1-B.
