Hi Folks,

It's been 6 years I am here in USA, did my Bachelor's and started working in IT. I worked on 1st and 2nd OPT(full 29 months)coz. did not get picked on H1b lottery both times. I am currently working with CPT( euta college le full time CPT deko cha). MY Employer is going to file my H1b again but the chances seem to be very less as most likely we see lottery again. In the mean time, I filed for saranarthi and I am elligible to apply for EAD(already more than 6 months but havent applied yet) but I am waiting for the last time to go through H1b ( uFF never wanted to go through second option but............). Lets say incase, I get picked up in H1b, do they refer me to for counselor section in home country? If they do, Can I apply EAD through saranarthi and do not leave the country?

Any suggestion will be highly appreciated.

I wish it don't happen to you for h1, but in the worst case if your h1 get picked up your change of status will be denied.

1) When you talk about the CPT, is it day one CPT? (you enrolled in a school and they will issue CPT right away)? How long you been working on CPT. I just came to know that you can't work more than 12 months on CPT.
2) If USCIS don't deemed the CPT as "integral part" of your course then most likely your change of status will be denied.

USCIS_Pidit bro, I think it doesn't mater how long you can work while in CPT. One thing I know is if you work on FULL TIME CPT for more than 12 months, you are ineligible to apply for OPT. But, if you work on PART TIME CPT for any number of time, it will not affect your OPT application. I think the same applies for H1B as well.

Hi Uscis_pidit,

Yes..I worked my 2 periods of OPT and joined the college providing CPT from first day. I am in my full CPT which is valid till August 2015. Not sure what would be the situation under this circumstances. The masters CPT and Bachelors are very different.

StatusPidit - I wish what you said was true but unfortunately it is not. If somebody gets lucky then he / she might get the approval but in most cases change of status will be denied. If you don't believe google (Change of status denied), you will know what I am referring too. Btw, from your nick name I infer that you are also "Status pidit", I hope everything will work out for you. My Best Wishes.

JaiPashupatinath - Trust me if this CPT is from day one, then most probably USCIS will ask about that. I am not saying it happens for everybody, but for most people COS has been denied because of this.

Bro, clearly says (regarding OPT and CPT)--
"If you have 12 months or more of full-time CPT, you are ineligible for OPT, but part-time CPT is fine and will not stop you from doing OPT."
