I entered USA in F1 visa, and now I am in H1B. I have not left USA after my H1B started. My Perm (applied by my employer in EB2) recently got approved. Since processing time is current for EB2, I want to concurrently apply I-140 and I-485 soon. However, I applied for MRP passport in the beginning of January and most probably I will receive new passport in a couple of months more. I have the copies of my old passport.
Is it ok to file I-485 with the copy of old passport (it is valid till 2017)?
Is passport mandatory for Biometrics appointment or will state driver license suffice?

Your opinion is appreciated.

Tecnically, passport is not mandatory and the driver license should suffice. Uscis site asks for any identification with photo. However, there were some discussions about some biometric centers asking for passport too.

yo I-140 and I-485 together apply garda health-checkup certificate, birth-certificate ahile nai chainchha ho ?

Ani mero birth-certificate 1 year aghi matra banako ho...i read somewhere that it should be dated back to your birth year...is that true ?

I remember sending the following documents while I filed my I-485:
1. Birth certificate
2. Marriage certificate or divorce certificate (ignore if u were never married and still single)
3. Medical exam report from USCIS approved medical doctors
4. Copy of recent I-94 card
5. Copy of visa you used to enter US
6. copy of biographic page of passport

If u r filing i140 n i485 together, u have to include the health check up n birth certificate in the same application. If ur birth certificate was made just a year ago, it's advised to get two affidavit, one from each parent, stating your birth on that day in that place. It's prederred that birth certificate be issued on the year of birth, if it is not, having birth affidavits with birth certificate is the way to go.

My PERM got approved in 5 months as well.

uhi_kya... These are the documents asked I have been asked to provide:

• Letter from Current Employer (with jobduties, skills and salary)
• All Approval/Receipt notices incl. curr. & prev. from initial entry into US
• Latest i94 front page color (attached to passport); backpage b&w
• passport pages ( incl. blank pages )
• copy of SSN, EAD, if applicable
• Copy of recent Bank statements (3 to 6 months)
• Birth Certificate: If name and/or date of registration of birth not mentioned, get affidavits from two family members stating the facts of birth. A certificate of non-availability of birth certificate needed from municipality English Translation document (certified) is needed if birth certificate is in foreign language.
• Copy of the marriage certificate, in English
• Medical Examinations need to be done in the US where applying for adjustment of status, and in the home country where applying for consular processing. Relevant forms can be obtained from the USCIS authorized physician (sealed envelope)
• Eight (8) Photographs for each applicant (including EAD and AP )
• Letter from applying employer (if different from the current employer) stating the current position, duties, and salary [for both petitioner and beneficiary in family based petitions] or where both applicants are employed in employment based petitions
• Form I-864 (Affidavit of Support) needed for dependent(s) of principal applicant where principal applicant has an employment based Form I-140 approved
• Copy of U. S. Income Tax Returns for the 3 recent tax years, if an Affidavit of Support in Form I-134 is to be submitted for dependent(s). A copy of the W-2 for the 3 recent tax years is also required, as well as copies of 6 recent months pay stubs
• Evidence of continued valid status during the entire period of stay in the United States for the principal applicant, as well as for the dependent(s), regardless of any employment authorization document received. This involves copies of all visas, notices of approval for continued permitted status, and Forms I-94. Copies of all EAD’s are also required, if any.

If I-140 and I-485 applied together, health-checkup form and birth-certificate will be required as far as I know.

My birth certificate was made a year ago. The certificate contains the information in Nepali on the top and in English on the bottom.
My father passed away few years back. I can get an affidavit from my mother only. Will affidavit from somebody else be accepted? If yes, then who?
Also, does any one have a sample of the affidavit for birth certificate?

Rock-N-Roll,
Get two affidavits, one from your Mom and one from either your uncle or Mama who knows about your birth. One is usually not enough for USCIS, they prefer two i believe.

A copy / paste from the affidavit of Birth Certificate that I'd used from a friend of mince. Had to scrape off from a pdf file so sorry about wrongly formatted texts. Overall this could be taken as a draft only and your folks in Nepal can work on it. Don't take it as an official template. This is what I had used. My friends had used different format and it still worked.

My apologies, I was not reading the thread entirely. The sample affidavit that I pasted above doesn't seem to be useful for applicants whose parents passed away, may their soul rest in peace.

I think, like I485 mentioned above, an affidavit from a Mama or an Uncle, a living parent should be enough. Above template is for reference only.
