Hello, I did not see any post on TPS for F2 visa holder. My wife is in F2 status and I do not like to apply for TPS. Can my wife apply for TPS and get the benefit. Also after 18 months if my visa changes to OPT or if it gets extended and in case I am in H1, can she come back to dependent status such as F2 or H4. Please send your thoughts.

As far I have noticed, I would recommend F-2 and H-4 dependents to apply for TPS and receive those benefits. Once they receive TPS, their status will be terminated (I am 90% confirmed with this rumor however we need a full confirmation though) and can work with their TPS EAD. Once, TPS ends, they can go back to Nepal and apply again for the dependent VISA and its not that tough for dependents to receive VISA in Nepal. You can't change status from USA ( I am 95% confirmed with this rumor however, we need a full confirmation though ). Dependents need to apply VISA from consulate officer. But, we need to make sure F-1/H1b holders have T.A/R,A/job so that US consulate officer abroad don't deny the visa. OR, Assume you get your degree, filed your H1B, filed your GC. And, TPS gets extended and extended. And, when you are about to file for I-485 and if TPS still exists, then she can adjust the status at that time, without leaving the US. (I am 85% confirmed with this rumor however, we need a full confirmation though). Good luck !!!

Booty Bro, what happen to my question, did you hear anything on H1b case with no EAD, how that is going to effect the H1b holders? Any adv/dis-advantage? Can we apply EAD on later date if required?

@lamps bro I have my appointment next wednesday. I will clear all the quesitons regarding H1B and H4 for sure. And will definitely let you know. I think with approved TPS , our H1b gets terminated. Once,TPS ends, we need to apply for H1 visa with US consulate abroad providing the facts that we meet all the requirements for that H1b. I don't think so we can apply for EAD later. However, I will get the full confirmation next week though. :)

As the lawyer said yesterday, you can hold F2 parallel with TPS. So when TPS is over you will still have F2 or H4. Coolbuddy: You are just throwing your opinion without any evidence.

Can a F2 obtain a TPS, work and then apply to F1 visa from within US? I am not sure if 'change of status' clause would permit F2 TPS holders to directly apply F1 visa from US.

@saNgee, the criteria is c19, while you file EAD application. once you get EAD card, you can go to Social Security office and get SSN and start making $$. You owe me dinner.

why would you won't your wife to apply for TPS. She already has a (legal) status. The main objective of TPS is to prevent out-of-status alien from being deportation. anyway, TPS won't change your wife's status. this means, If your wife is on F2 (or any other NIV status), her TPS approval will not affect her F2 status nor she will run out of it for applying TPS. she will remain on F2 as long as you maintain your F1 status. she will be able to apply for change of status for H4 once your petition for H1b (form I-140) gets approved and you get a notice of approval from USCIS.
