There is a specific instructions on how to apply TPS and What is NOT TPS.
And Attorney Chettery clearly explains about TPS in his video interview that posted here on Sajha.
What else these Stupid Pakey Greedy H1B/Students are keep asking Stupid questions here on Sajha.
H1b/Students are already in legal Status, try to maintain that Status, what else,,TPS is not a path to Green card.
Attorney Chettery already indicated in his interview TPS may be not a good idea for those who has been here already in legal status or pending asylum cases. As he suggests, use it as last option before the expiration period of 180days if you want to have TPS. Such a nice suggestions.
Why would you want to have two EAD with you? So stupid..
IF your case is so complicate, then hire an attorney.
THIS IS NOTa programming class, trying to get a correct code asking here and there...zeee..

IF you are out-of-status, need to work, then you apply for TPS/EAD..spend $551 dollar to USCIS, get a
work permit card which is valid for 18 motths..work day and night, make money, then again apply for
Advance Parole (another $ 600plus spend to USCIS), buy ticket to Nepal, have fun, re-enter US again
IF you are here on a visitor visa, don't feel like to go to Nepal, of course you don't, want to make more
dollar , then you apply for TPS/EAD..

Hi SIS, Doesn't Out-of-status accrue unlawful presence? and then even with advance parole, the POE officer could deny admission into the US, am i right or wrong? Shed some light on plz.

Yup, that's why they recomment talking to an immigration lawyer about travel. Shud have a very convincing reason to go to Nepal and come back otherwise the POE officer would say, "So you were staying in US for years unlawfully, you got TPS which is given on the basis that you guys cannot go back or deported back to your country because of recent earthquake and yet here you are, travelled to ur contry right after getting TPS....hmmm...let me think, i personally believe its safe for you to travel to Nepal.....so....."

Sis, Nepali students are getting confused because of dumb arse lawyers in avvo.. who give conflicting and wrong answers in the same thread. It seems like most of the answers are just posted in there even without a good research. I advise all our brothers to pay extra attention and carefulness when you try to gain some information from avvo.com or such answer sites in the web. I would also like to suggest direct calling USCIS or ask read some of the views by gorton law in sajha. Sis, who says the TPS is not meant for f1s and h1s? It is a benefit given by the USCIS for all Nepalis who haven't committed any crime and who was in the usa before june 24th. Why not use it what is given. TPS will allow thef1 to work and feel secure for job hunting. same with h1, it practically removes the slavery that comes with h1 and given open access to the job market when it come to legality of working in the US. I am surprised that you actually went ahead in name calling the f1s and h1b as greedy and stupid. They are not greedy, they are the most respectable folks in the Nepali immigrant community who are working hard to pursue their happiness. With TPS they are trying to do it legally, so what's wrong with that? and they are definitely not stupid because they are f1 and h1b going go school or who graduated and working in us work force that requires brain. please have some respect. Programming assignment is hard and if it requires asking around it just means someone is doing research, unless someone blatantly copies it, nothing wrong with that.

Sexy Bro, I had to Laugh Out Loud at our post. This is what the forum is for, help each other and clear out the confusion. I don't understand what is so greedy and stupid about that? Everyone is already aware that TPS is not straight forward as everyone was thinking. If you have options available in front of your you would like to access the available options and keep back-up plans for future. If you have problem with bunch of H1/F1 posting on TPS then just ignore it. Whats the big deal?

SexyinSari I have to disagree with you on this. It is completely OK to be confused and ask the questions here. That's what this platform is for. It is also fine to wonder and look for the possibilities to take advantage of the benefit that has been offered. No matter the person is F-1 H-1 illegal or whatever. Gwaach
