 TPS To GC Consular processing?

Hello all,

Do you know if it is necessary to go consular processing route if you are only on TPS and your company wants to file a GC, or you can just adjust your status in the United States?

Prior to TPS, if you are out-of-status for sometimes (ref detail on time bar for out of status), then you need to go for consular processing once 485 is approved. Your immigration attorney should be able to handle your case while processing your GC, let them know your status. It's a long process- prevailing wage approval-advertisement-Labor-140-765/131-485.

neeram , is correct you might have to consular processing given you were out of status for more than 180 days. I saw some recent article where a judge made a precedent that even when illegal you can switch status.

Lawyer would be the best person to reference on this.
