म अहिले Randstad भन्ने staffing कम्पनी को thorugh बाट अर्को client कम्पनी मा काम गरिराको छु । मेरो OPT को Initial period अगस्त मा सिद्धिन्छ । मेरो अहिले काम गरिराको client ले मेरो H1B अप्रिल मै file गरेर मलाई Full time hiring चाही अक्टोबर मा मात्रै गर्ने भन्छ . अनि तेतीनजेल चै Randstad बातै OPT Extension गर्ने भन्छ । यसरी H1B filing चै client कम्पनी बाट अनि OPT extension चै staffing कम्पनी बात गर्दा केइ समश्या त पर्दैन ? USCIS को मार्च ११ को रुल अनुसार्, Staffing consultancy हरु OPT Extension बात qualify हुँदैनन हो ?

You are working through Randstad consultancy is under OPT. Make sure that OPT can be extended. OPT extension is done by University, not Randstad. University need to apply USCIS for your OPT extension. H1B filing: Your current client can file H1B on April 1st. Under current turmoil situation, you might be knowing that H1B minimum Salary should be 130K to apply for H1B, if new bill is passed. We do not know what holds in future about H1B now. So, applying H1B is a risky game. Even if H1B bill is not passed, getting H1B is purely a luck as its based on quota/lottery. Another thing, if there is a contract between Randstad and your client company, not to hire you directly, you may not be able to join the client, as that violets the contract. Your client might not be willing to hire you directly. So, all depends on your OPT extension period to change of status. If you have TPS, you can ask your client to file GC rather than H1B.

What types of employment are permissible during the STEM OPT period? The 24-month STEM OPT period is limited to certain employers and employment opportunities, as follows: As noted above, a STEM OPT employer must be enrolled in and using the E-Verify program at the STEM OPT worksite. A STEM OPT employer must have an Employment Identification Number (EIN). The employment opportunity must be directly related to the student’s qualifying STEM degree. There must be an employer-employee relationship between the employer and the F-1 student. During the STEM OPT period, employment for a staffing agency and other labor-for-hire arrangement will not qualify. Volunteer employment does not qualify. An F-1 may not work concurrently for multiple employers during the STEM OPT period.
