By now we all have heard about "Federal agents conduct sweeping immigration enforcement raids". Please be aware according to American Immigration Lawyer Association... this target is focusing on following individuals:
Fugitives - Anyone with an outstanding order of removal;
Individuals who reentered after they were deported. No need for criminal conviction related to reentry to be targeted;
At large "criminal aliens" - Anyone with any criminal conviction.
My message to the concerned Nepalese present in USA currently on temporary protected status and if you don't fall in the above three group please don't panic. You are lawfully here as your status is protected until June if 2018.
If you have Asylum pending and if you don't fall under the above three groups. You have a right to fair hearing and due process of law until you have credible hearing.
Also if you have pending application such as U visa you will be low on priorities for deportation.
We have recently heard that ICE ( immigration and custom enforcement) have raided in several communities however please understand ICE does this periodically it might not be only due to recent administration.
To the Nepalese community: please keep your work permit card or any receipt you have received after you filed any application. Don't sign any papers. Ask for the interpreter or don't speak until you have your attorney.
Most importantly stay vigilant. Stay out of unnecessary trouble. Don't drink and drive (applicable to all for this could be enough to get you deportable). However, if you are victim of any crime please report it to the law enforcement. America is country where your immigration status has never been a basis of abuse against you.
There are lots of rumors going on around either among Nepalese online media or social networks. There are lots of changes, unclear policies now so please talk to your attorney.
