I am U.S citizen. I am not working since last three years because I decided to go to school and comptete my degree first. I want to file a petition for my husband who currently is in F1 status. We are married for 4 years. My spouse already has his Master degree and he is enrolled in college just to be in status so that we can file his AOS while he is legal status. My question are as follows:
1. Can I still file petition for him with co-sponser?
2. Can he leave the college once we apply for AOS?

1. You can file petition for him anytime as long as you have a co sponsor. 2. Yes he can. He can technically leave college now and still get GC thru you.

if he entered USA by Inspection and you are US citizen no worries. File all I485/131/765 same time- he will get EAD in 60-90 Days, he ill be legal until approved and he will get green card with in 6-9 month if everything goes well this is not a legal advice.
